9. The violation a i n is a result ofe engineering ng neering measurement error made without
applicants' knowledge or approval Without the needed variance, the first
mortgagee bank will refuse to advance the funds remaining in its due-borrower
account for the completion of the construction of the premises. The violation
constitutes a defect or cloud on the title to the premises sufficient to affect future
marketability. The dwelling was situated at its present location to accomodate
circumstances relating to soil conditions, slope, topography, and sewer access
especially affecting this lot and dwelling but not affecting the zoning district in
general; a literal enforcement of the provisions of this By-law will involve sub-
stantial hardship, financial or otherwise, to the applicants, and desirable
relief may be granted without substantial detriment to the public good and without
nullifying or substantially derogating from the intent or purpose of this By-law.
