The principal points upon which I base my application are as follows : ( must be stated in detail) Applicant purchased the premises as 2 separate lots in 1976 but did not separateownership. There are many small lots in this multi-family area, and applicant wishes to separate lots according to plan and erect a single family house on Highland View Avenue , which will not derogate from intent of'by-laws nor constitute a detriment to the neighborhood. Andover, MA 01845 DECISION The Board of Appeals held a public hearing on February 9, 1988 on the application of Constantine Stoupis requesting a variation of Section 7, Paragraph 7.1, 7.2, 7.3 and Table 2 of the Zoning Bylaws so as to permit subdivision of existing lots fronting on two (2) streets in order to erect a single family dwelling on the premises located at 69-71 Brightwood Avenue. The following members were present and voting: Frank Serio, Jr., Chairman, Alfred Frizelle, Vice-chairman, Walter Soule, Anna O'Connor and Louis Rissin. The hearing was advertised in the North Andover Citizen on January 21 and January 28, 1988 and all abutters were notified by regular mail. Upon a motion made by Mr. Frizelle and seconded by Ms. O'Connor, the Board voted, unanimously, to DENY the variances as requested. The Board finds that the petitioner has failed to satisfy the provisions of Section 10, Paragraph 10.4 of the Zoning Bylaws and that the granting of this variance would derogate from the intent and purposes of the Zoning ByLaws and would adversely affect the neighborhood.
