i Upon review of the materials submitted by Bayfield Company and from
� information received during the public hearing on this matter the
� planni Board makes the following findings regarding this preliminary
subdivision prucosal :
1 . A letter from NACC dated February 29, 1988 regarding the
" limited project" status of this proposal including suggesting
. three < 3} alternative ways in which the roadway could be
connected . A letter from Bayfield company dated May 24, 1988
along with additional information supplied by the applicant
during the hearing shows the alternatives suggested by NACC have
been thoroughly reviewed and the existing proposal provides the
best alignment and alternative possible, doe to existing
conditions found in the industrial park .
2. The Board will not approve any common driveways under a Special
Per'nit application, nor will the Board accept a driveway
connection between the two existing roadways" The Board finds
the roadway as designed provides a degree of access necessary
for the safe utilization of the land for industrial use. ~
3 , The Board is in receipt of the February 29, 1988 memo from Gary
Clayton, Wetlands Division Director of the DEQE regarding
limited projects for roadways under Section 10.53(3) (e) of the
Wetlands protection Act . The memo states the NACC may determine
and review the proposal before us as a limited project , provided
the design is the "minimum length and width is acceptable to the
Planning Board" and that the "applicant has made a good faith
effort to identify alternative means of access and has actually
' presented any reasonable alternatives to the Planning Board and
received that Boards ruling. " The Board finds that the
applicant has made a good faith effort to find alternatives and
� that we find the current proposal before us reduced the minimum
design standards for a roadway consistant with the public health
and safety. in addition_ the design as proposed will provide
for a connected road system for this industrial park , long
sought by this Board .
4. The Board finds that any alternative alignment of the roadway
would be difficult if not impossible to obtain, with no
resulting benefit to the public health and safety. Both
Flagship Drive and Willow Street South are built and land on
both sides of Willow Street and one side of Flagship Drive are
� not owned by the applicant , or is cut-off by a body of
wetlands, The Ogan Foods Building is built on parcel A~1 which
venders the NACC suggested crossing at the narrowest point of a

finger of wetlands adjacent to this structure impossible to
�
ubtain without demolition of the existing parking lot and
� .
possibly a portion of the building itself . In fact the only
�
reason the connection can occur in this current proposal is by
Ogan Foods agreeing to a land transfer with Bayfield Company for
a portion of Parcel A`1 .

minimum slopes, and the alignment of the roadway; while not
incorparating the best engineering principals, is designed to

Planrinr, Board finds that the preliminary subdivision pian
before us is the best possible design available to the applicant .
6. The Planning Board finds that the construction of the roadway as
desi;.;,ned , promotes the public health , safety and welfare of the
communi -z�y and is in keeping with sound and proper land use
planninc principals.
7. The plans submitted and before us meets the submittal
re(- ui.;-caients of the Subdivision Rules and Regulations .
Pased upon the findings cited above the Planning Board hereby
o>>ditionally :approves the preliminary subdivision plan of North Andover
Business Park F:-:tension with the following conditions:
1 . f"hs applicant shall contribute towards the installation of
lights at the intersection of Willow Street and Route
11�- . The Planning Hoard finds that the applicant should share
in the portional cost towards providing traffic lights due to
the additional traffic to be generated by the construction of
this proposal and the resulting development on the new lots
c'rrya ted .
w . Th_ existing cul--de-sac for Flagship Drive and the existing
roa,,�way fo - Willow Street South be redesigned and re-built in
conformance with the requirements of the DPW, once the extension
i crmpieted .
J . The Planning Board hereby waivers the applicable standards
included in the rules and regulations necessary for the
construction of the roadway as shown in the plans before us.
Tile Board waivers these requirements due to findings cited in
thio decision in order to promote the public health , safety and
c;:eree-al welfare and to accommodate, to the extent possible, the
in finding this subdivision plan a limited project under

4 . A =stump pit burial plan shall be submitted to the Board and
approved prior to construction of the roadway.
5. A detailed tree cutting plan shall be submitted with the
de*initive subdivision plan. Said plan shall be designed to
preserve existing trees as much as possible.
6. ANotice of Intent shall be filed with the NACC as required
under Chapter 131 , and the local wetlands bylaw.

A definitive subdivision plan submitted under this preliminary
plan subdivision plan approval shall meet all applicable
procedures and standards contained in the Subdivision Rules and
Regulations .

Dear Board Members
Attached please find preliminary plans for a 24,000 sf facility for W.B. Kent & Sons Moving
Company of North Andover. The Kent company's existing facilities are no longer adequate for
their needs. The company wishes to remain in North Andover and is proposing to move from
its present location at Route 114 and Hillside Road to a new site on 16.94 acres of land owned
by Me Bayfield Company(as Riding Realty Trust). Channel Building Company intends to do the
construction work during the upcoming season. I wish to clarify the proposed use under the
North Andover Zoning Bylaw prior to beginning the permit process with the Town Boards.
The parcel under consideration was acquired by Riding Realty Trust in January of 1985. (See
attached deed). At that time the parcel was zoned (1-1) Industrial 1. Town meeting of 1987
rezoned the land (VR) Village Residential. However, the owner has recorded a Form A plan,
endorsed by the North Andover Planning Board(see attached plans) which shows the land as
(1-1) Industrial 1 zone. Under the provisions of Section 6 of the Zoning Act(M.G.L. Chapter 40A)
"..the use of the land shown on such a plan shall be governed by applicable provisions of the
zoning ordinance or by-law in effect at the time of the submission of such plan... for a period of
three years from the date of endorsement by the planning board..,' Consequently this land Is
subject to current regulations for the 0-1) industrial 1 zone until April 27, 1990. It is the Kent
Company's intention to develop the property as a single site as represented on the plans.
The proposed use is the business offices and national headquarters of a moving business. The
company moves belongings for persons, families and businesses around the country. As such
most of their activities are off-site. they also specialize in moving mainframe computers for major
corporations such as Digital Their proposed facility would contain approximately 2,000 sf offices,
9,000 sf staging and unloading areas and 13,000 sf of entirely indoor non-industrial storage for
goods in transit in the form of wood and high strength p*styrene storage units and forklift truck
access aisles.
Business offices are permitted as a matter or right in an (i-1) industrial 1 Zone as per section
4:131 paragraph 2 of the Zoning Bylaw. However, the square footage devoted to indoor storage

Bylaw by the term 'accessory use'as per section 4.131 par 16. In other words while storage is

a position. I refer to Material installations an installer and reconditioner of office partition
systems, and Contact Fast a mail order supplier of hand tools used in the electronics industry;
both located in the North Andover Business Park Each faciNfy is, like W.B. Kent and Sons, the
principal business office of the company. in each case the Building Department determined that
while a substantial amount of square footage was devoted to storage, that the characteristics and

INTRODUCTION
1. This is a complaint pursuant to G.L. c. 40A, § 17,
to annul a condition imposed by a decision of the Planning
Board of the Town of North Andover ("the Board") approving
the plaintiff's Site Plan on February 26, 1988 (Exhibit A) .
PARTIES
2. The plaintiff Lynne Trombley is the successor
Trustee of the Optryx Trust which owns land at 1070 Osgood
Street ("the site") in North Andover. The plaintiff is an
aggrieved party under G.L. c. 40A, § 17, who is and will be
directly, substantially, and adversely affected by the
condition imposed on the site plan approval by the Board.
3. The plaintiff, Channel Building Company, Inc.
("Channel") is a corporation duly authorized to conduct
business in the Commonwealth of Massachusetts, with its
principal place of business located on Main Street, Andover,
MA. The plaintiff is an aggrieved party under G.L. c. 40A,
§ 17, that is and will be directly, substantially and
adversely affected by the condition imposed on the site
plan approval by the Board.
4 . The defendant Board is the duly constituted
Planning Board of the Town of North Andover. The names and
addresses of the defendant members of the Board are as

FACTS
4 . Optryx Trust filed a perimeter plan and Form A
application for the site with the North Andover Town Clerk's
office on April 26, 1985.
6. On May 6, 1985, the Chairman of the Board endorsed
the plan "Approval Under Subdivision Control Laws Not
Required." The Plan was recorded in the Registry of Deeds

as Plan Number 10185 on February 26, 1986. A photoreduced
copy of the plan is attached as Exhibit B.
7. General Laws c. 40A, § 6 states that the use of
the land described on a plan submitted to a planning board
under c. 41, § 81P (the Approval Not Required section)
"shall be governed by applicable provisions of the zoning
ordinance or by-law in effect at the time of submission of
such plan . . . for a period of three years from the date of
endorsement by the planning board that approval under the
subdivision control law is not required."
8. At the time Optryx Trust submitted its perimeter
plan and Form A application to the Board on April 26, 1985,
the Site Plan Review provision contained in section 8.1(12)
of the North Andover zoning by-law was not a special permit
process. Instead, Section $.1(12) required an applicant to
submit to the Board certain plans which would then be
submitted to other town boards "for their review and
recommendations." Under this provision, the Board could
impose limited, reasonable conditions on an approval but
could not deny site plan approval.
9. In June, 1987, Channel submitted on behalf of
Optryx Trust an application for Site Plan Review that fully
complied with the requirements of Section 8.1(12) .
10. On February 26, 1988, the Board approved Channel's
site plan but delayed issuance of the building permit for
the site until Channel complied with the following condition

The applicant shall submit to the Planning Board prior
to the issuance of a building permit, h drologic and
geologic investigations which shall include the
following: drilling of observation wells, to obtain
boring data; stratigraphic profiles; a pumping test,
water sampling and geologic mapping, in order to
determine if the potential exists of contaminating Lake
Cochichewich due to a hydrologic connection of this
sites watertable to the lakes watertable [sic] . . .
11. The site lies outside the watershed district
established by the North Andover zoning by-law. At the time
Channel submitted its perimeter plan and Form A Application
to the Board on April 26, 1985, the Watershed District
by-law, Section 4 .133, contained no building moratorium and
granted no authority to the Board, to impose a condition
requiring such geohydrological investigations.
12. Moreover, at that time, the Watershed District
by-law required a special permit from the Board only for
construction within 250 of Lake Cochichewich and 100 feet
laterally of the Lake's tributaries . Channel's construction
plans for the site do not require a special permit under
Section 4.133 because any construction will occur more than
250 feet from the Lake's annual mean high water mark and
more than 100 feet from any of the Lake's tributaries.
13. After Optryx Trust filed its Form A application,
the Site Plan Review provisions and the Watershed District
provisions of the North Andover zoning by-law were amended
by Town Meeting. Because of the endorsement of Optryx
Trust's perimeter plan under G.L. c. 41, 5 81P, however, the
site is grandfathered from the moratorium and special permit

provisions of these amendments. As a result, these
amendments do not permit the Board to prohibit a permitted
use of the site, nor do they authorize the Board to require
geohydrological investigations prior to the issuance of a
building permit.
14. By imposing Condition 7 and delaying issuance of
the building permit, the Board has exceeded its authority
under G.L. c. 40A and under the zoning by-law of North
Andover. Without limiting the generality of the foregoing,
the Board exceeded its authority because (a) the site lies
outside the watershed district, (b) the imposition of the
condition was not authorized by the by-law in existence when
Optryx Trust submitted its perimeter plan and Form A
application, and (c) the Board has in effect prohibited a
permitted use of the site. The Board's improper action has
caused hardship, delay and increased costs for the
plaintiffs.

WHEREFORE, the plaintiffs pray that this court (1)
annul condition 7 in the Board's decision of February 26,
1988, (2) award the plaintiff their costs and expenses for
this suit, and (3) grant such other relief as the court
deems just and proper.

Dear Mir . Long:
The North Andover Planning Board held a Public Hearing on Monday
evening, July 20, 1987 at 8:00 p .m, in the Town Hall Meeting Room upon
the appiiation of Channel Building COmpany, Incorporated of Andover .
MA. The hearing was advertised in the North Andover Citizen on July 2
and July 9. The following members were present at the July 20, 1987
meeting: Erich Nitzsche, Chairman; Paul Hedstrom, George Perna, John J .
Burke and John Simons.
The petitioner seeks a Special Permit under Section 8, paragraph
3; Site Plant Review of the North Andover Zoning Bylaw. The purpose of
the Site Plan Special Permit is to review the proposal to construct a
new office building with associated parking . The site is located on the
North side of Osgood Street between the City of Lawrence Airport
property and the Borden Chemical Company property , across for the Great
Pond Road intersection at Osgood Street . Said lot possesses 91 ,089.6
square feet of land area with 245 ' of frontage in an Industrial-2 Zoning
District,. At the continued hearing on October 5, 1987, the Board was
informed that Channel Building had obtained an Order of Conditions from
the North Andover Conservation Commission. A motion was made by John
Burke to close the public hearing and take the matter under advisement .
Seconded by George Perna, the vote was unanimous.
After several meeting that were held , October 22, 1987, November
23, 1987, December 3, 1987 December 17, 1987, and January 21 , 1988? the
Board met on February 25. 1968 to render the decision. The following
members were present and voting, Paul Hedstrom, Chairman; George Perna,
VIce-Chairman; John Simons, Clerk ; and Erich Nitzsche. John Burke was
absent:. A motion was made by John Simons to approve the draft decision,
changing the wording in condition #6 and adding an additional condition,
#t8, seconded by Erich Nitzsche and voted unanimously.

< 1070 Osgood Street - Site Plan Review
Conditional Approval
1 . . The Massachusetts Aeronautics Commission (MAC) , Letter dated
August 24, 1987, states the project needs two red hazard beacons
and they shall be placed upon the building. No structure shall
be higher than 172' MSL.
2. Agreement/approval from the Commonwealth for traffic light work
at the intersection of Osgood Street and Great Pond Road.
3. An automatic fire detections and suppressions system
( sprinklers) must be installed . These systems shall be
connected to the municipal fire alarm system through a master
fire alarm box . The developer- must contact the Fire Chief for
the requirements for these systems prior to installation.
4 . No underground fuel storage will be permitted for this project .
S. No open burning is permitted , except during open burning season
and only in compliance with the Fire Department regulations.
6. No building permit shall be issued for this site, prior to the
start of construction of the sewer facilities which will serve
this project .
7 . The applicant shall submit to the Planning Board prior to
issuance of a building permit , hydrologic and geologic
investigations which shall include the following : drilling of
observation wells , to obtain boring data; stratigraphic
profiles; a pumping test , water sampling and geologic mapping ,
in order to determine if the potential exists of contaminating
Lake Cochichewick due to a hydrologic connection of this sites
watertable to the lakes watertable. The Board requests this
information in order to safeguard and maintain the quality of
the Town ' s water supply.
8. No Certificate of Occupancy shall be issued for the building ,
prior to the Planning Board receiving a certification from the
designer of the project that the project was constructed
according to the plans cited and approved by this decision.

Dear Mr . Long :
The North Andover Planning Board held a Public Hearing on Monday
evening , July 209 1987 at 8:00 p .m. in the Town Hall Meeting Room upon
the appliation of Channel Building COmpany, Incorporated of Andover ,
MA. The hearing was advertised in the North Andover Citizen on July 2
and July 9. The following members were present at the July 20, 1987
meeting : Erich Nitzsche, Chairman; Paul Hedstrom, George Perna, John J.
Burke and John Simons.
The petitioner seeks a Special Permit under Section B, paragraph
3; Site Plant Review of the North Andover Zoning Bylaw. The purpose of
the Site Plan Special Permit is to review the proposal to construct a
new office building with associated parking . The site is located on the
North side of Osgood Street between the City of Lawrence Airport
property and the Borden Chemical Company property, across for the Great
Pond Road intersection at Osgood Street . Said lot possesses 91 ,089.6
square feet of land area with 245 ' of frontage in an Industrial-2 Zoning
District . At the continued hearing on October 5, 1987, the Board was
informed that Channel Building had obtained an Order of Conditions from
the North Andover Conservation Commission. A motion was made by John
Burke to close the public hearing and take the matter under advisement .
Seconded by George Perna, the vote was unanimous.
After several meeting that were held , October 22, 1987, November
23, 1987, December 3, 1987 December 17 , 1987, and January 21 , 1988, the
Board met on February 25, 1988 to render the decision. The following
members were present and voting, Paul Hedstrom, Chairman; George Perna,
Vlce-Chairman; John Simons, Clerk ; and Erich Nitzsche. John Burke was
absent. A motion was made by John Simons to approve the draft decision,
changing the wording in condition #6 and adding an additional condition,
#8, seconded by Erich Nitzsche and voted unanimously.

1070 Osgood Street - Site Plan Review
Conditional Approval
1 . . The Massachusetts Aeronautics Commission (MAC) , Letter dated
August 24, 1987, states the project needs two red hazard beacons
and they shall be placed upon the building . No structure shall
be higher than 172 ' MSL.
2. , Agreement/approval from the Commonwealth for traffic light work
at the intersection of Osgood Street and Great Pond Road .
3. An automatic fire detections and suppressions system
(sprinklers) must be installed . These systems shall be
connected to the municipal fire alarm system through a master
fire alarm box . The developer must contact the Fire Chief for
the requirements for these systems prior to installation.
4 . No underground fuel storage will be permitted for this project .
5. No open burning is permitted , except during open burning season
and only in compliance with the Fire Department regulations.
6. No building permit shall be issued for this site, prior to the
start of construction of the sewer facilities which will serve
this project .
7. The applicant shall submit to the Planning Board prior to
issuance of a building permit , hydrologic and geologic
investigations which shall . include the following : drilling of
observation wells, to obtain boring data; stratigraphic
profiles; a pumping test , water sampling and geologic mapping ,
in order to determine if the potential exists of contaminating
Lake Cochichewick due to a hydrologic connection of this sites
watertable to the lakes watertabie. The Board requests this
information in order to safeguard and maintain the quality of
the Town ' s water supply.
8 . No Certificate of Occupancy shall be issued for the building ,
prior to the Planning Board receiving a certification from the
designer of the project that the project was constructed
according to the plans cited and approved by this decision.

The proposed addition complies with the provisions of the- zoning bylaw. ParkinK
beyond what' is required will also be provided. The proposal construction will utilize
a small area of suitable (upland) land which has no other development potential beingL
trapped between the boundary of the North Andover Business Park and adjacent wetlands.
The addition will continue the attractive contemporary design aesthetic of the existing,'

The North Andover Planning Board held a public hearing on
Monday evening, March 16, 1987 at 8 :30pm in the Town Office Meeting
Roam upon the application of James Bourgeois, for Bianchi Realty
Trust (Eastprint, Inc. ) , The hearing was duly advertised in the
North Andover Citizen on February 26 and March 5, 1987. The
following members were present: Erich W. Nitzsche, Chairman;
Michael P. Roberts, Vice-Chairman; John L. Simons, Clerk; and
John J. Burke .
The petitioner seeks a Special Permit under Section 8,
paragraph 3; Site Plan Review. The purpose of the Site Plan
Special Permit is to review the proposal to construct an addition
to a building with over 10 parking spaces. The premises affected
are located on the east side of Willow Street (350 Willow Street)
possessing 7 .67 acres with a frontage of 472 feet in an Industrial -1
(I-1) Zoning District.
John Simons read the public hearing notice and letters from
the Health, Police and Fire Departments into the record.
Jim Bourgeois, Channel Builders of Andover requested a continuance
of the public hearing in order to address the concerns of the
Fire Chief as stated in his letter.
MOTION: By John Burke to continue the public hearing until
April 27, 1987.
SECOND: Michael Roberts

VOTE: Unanimous
Jim Bourgeois from Channel Builders of Andover discussed the
addition to the existing building. He explained that the Eastprint
Company produces (industrial) adhesives and labels and that the
addition complies with the zoning bylaw. He stated that the drainage
pipes will be extended 100 feet and that a new headwall will
be constructed.
MOTION: By John Burke to take it under advisement and to close
the hearing.

The following decision was rendered on July 20, 1987 Board
Meeting.
1. In accordance with the North Andover Health Department
recommendations, the applicant shall take adequate
measures to prevent erosion from polluting the adjacant
wetlands.
2'. In accordance with the North Andover Fire Department
recommendations, the applicant shall provide adequate
access to the rear and to the side of the addition.
3. In accordance with NACC Order of Conditions DEQE File No.
242-396.
In conditionally granting this special Permit, the Planning
Board finds pursuant to Section 10 .31 , Conditions for Approval
of Special Permits of the Zoning Bylaw the following:
- Willow Street site is an appropriate location
for the proposed USE;
- The USE, will not adversely affect the neighborhood;
- There will be no nuisance or serious hazard to vehicles
or pedestrians if the applicant complies with the
aforementioned stipulation in the decision.
- Adequate and appropriate facilities, such as town
water, sewer and adequate parking and green space,
will be provided for proper operation of the
proposed uses.
Based on site visits, the hearing process, and reviews
from other departments and agencies, the Planning Board will
permit the allowed USE to be considered harmonious with the
general purpose and intent of the Zoning Bylaw.
