The principal points upon which I base my application are as follows:
Applicants property was tied up in litigation in Essex County
Superior Court at the time the Zoning Change frcan R2 to RI occurred. The
Property was purchased and being held by the application to fund her
retirement. The applicant was unable to proceed with division of her
Property as shown on enclosed plans. To require her to meet the new
Zoning Request would be confiscatory and constitute an extreme financial
hardship. Relief may be granted without substituting detriment to the
public good and are substantially derogating from the general intent and
purpose of the Zoning By-Law.

The Board of Appeals held a public hearing on Tuesday evening, May 1, 1990
upon the application of Anne E. Gilbert requesting a variation from the re-
quirements of Section 7, Paragraph 7.1, 7.2 and Table 2 of the Zoning Bylaw
so as to permit division of land into six (6) lots on the premises located
at 701 Forest Street. The following members were present and voting: Frank
Serio, Jr. , Chairman, Augustine Nickerson, Clerk, Walter Soule, Raymond
Vivenzio and Louis Rissin.
The hearing was advertised in the Lawrence Eagle Tribune on April 13, 1990
and April 20, 1990 and all abutters were notified by regular mail.
Upon a motion made by Mr. Soule and seconded by Mr. Vivenzio, the Board
voted to GRANT the variance. The vote was as follows: In favor, Serio,
Nickerson, Soule and Vivenzio, opposed: Rissin, therefore the petition
was granted.
The Board finds that the petitioner has satisfied the provisions of Section
10, Paragraph 10.4 of the Zoning Bylaw and that the granting of this variance
will. not derogate from the intent and purpose of the Zoning Bylaw nor will it
adversely affect the neighborhood.

The Board of Appeals held a public hearing on Tuesday evening, February 13, 1990
upon the application of Ann Gilbert, c/o.Attorney J. J. Willis requesting a
variation from the requirements of Section 7, Paragraph 7.2 and Table 2 of the
Zoning Bylaw so as to permit relief from area and frontage requirements on the
premiseslocated at 701 Forest Street. The following members were present and
voting: Frank Serio, Jr. , Chairman, Augustine Nickerson, Clerk, Walter Soule,
and Raymond Vivenzio.
The hearing was advertised in the North Andover Citzien on January 25, 1990 and
February 1, 1990 and all abutters were notified by regular mail.
Upon a motion made by Mr. Vivenzio and seconded by Mr. Nickerson, the Board
voted, unanimously, to GRANT the variances as requested, subject to the follow-
ung conditions:
1. Petitioner be allowed to WITHDRAW WITHOUT PREJUDICE the
petition for variance for all of the land except Lot A
and Lot C, listed at the Registry of Deeds as Lot A-6757
and Lot C-7809.
2. Area and frontage relief granted as requested on these
two lots.
The Board finds that the petitioner has satisfied the provisions of Section 10,

Description of relief sought on this petition:
Petitioners property was under litigation at the time of the rezoning
of the area to Rl. Petitioner needs a variance of frontage so as to allow
the use of her property for Six (6) lots. She will also need a variation
of the contiguous buildable area requirement which was enacted subsequent
to the litigation at the time of the lawsuit petitioner had Seven (7) lots
available under the then R2 Zone. Relief may be granted without detriment
to the neighborhood and without.serious derogation from the intent arra
purpose of the By-Law. Proper facilities will be provided to accamodate
the use interxled. Denial would create a serious detriment to the

The Board of Appeals held a regular meeting on May 1, 1990, continued to June 12, 1990
and a Special meeting on June 25, 1990 upon the application of Anthony & Frances
Szelest requesting a variation from the requirements of Section 4.2, Paragraph 1 thru
8 of the Zoning Bylaw so as to permit construction of single family residences on
10 lots in a 12 lot sub-division on the premises located on Lots 4,6,9,10 and 11 on
Boxford Street. The following members were present and voting: Frank Serio, Jr.,
Chairman, Walter Soule, Clerk, Raymond Vivenzio, Anna O'Connor and Louis Rissin.
The hearing was advertised in the Lawrence Eagle Tribune on April 14, 1990 and on
April 16, 1990 and all abutters were notified by regular mail.
Upon a motion made by Mr. Rissin and seconded by Mr. Soule, the Board voted, unanimously,
to GRANT the variance as requested.
The Board finds that the granting of this variance will not adversely affect the
neighborhood nor derogate from the intent and purpose of the Zoning Bylaw.
