Petition #5-174
John J'', Lyons, Town Clerk
Town Wfice Building
North 'Andover, Mass.
Dear Sir:
A public hearing was held by the Board of Appeals on March 11g 1974 upon the
application of John J. Good who requested a variation of See. 6.3 and Table 2
of the Zoning By—Law so as to permit an addition to,an existing dwelling which
would 'be closer to the side lot line than is allowed by the Zoning BY-Law
located at the northerly side of Farnum Street at the corner of Sumer Street
and known as 62 Farnum Street. The following members were present and voting:
Frank Serio, Jr.t Chairman; Dr. Eugene A. Beliveaup Clerk; R. Louis DiFruscio#
and Associate Members Alfred E. Frisellet Esq. and James D. Noble, Jr.
The hearing was advertised in the Lawrence Eagle-Tribune on February 23 and
March:29 1974• All abutters were duly notified by regular mail.
Mr. Good appeared in his own behalf and
explained that the addition. could not be
placed in the rear because it would be directly over the septic tank; there is a
drop-off on the other side of the house where he allowed the town to cut a cul—
vert. ' This is the only We that the addition could be placed on and it would
be only 13 feet from the sideline. Building Inspector Charles Foster explained
that the house is located in this particular spot because part of the lot is very
wet and unsuitable for building# so that there is a hardship. Mr. Grey's houses
the immediate abutter an the side of the proposed additionp is approx. 39 feet
from the lot line; and he was recorded in favor of the variance. There were no
abutters present and there was no opposition.
The petition was taken under advisement and at a meeting held on March 281 1974r
at which all of the same members were presents further discussion was held. Mr.
DiFruacio made a motion to GRANT the variance; Dr, Beliveau seconded the motion
and the vote was unanimous. The Board found that there is a hardship because
of the existing conditions on the lot, such asp the area being wet, the town

cutting a culvert and the location of the septic tank. The fact that the
immediate abutter's home is located some 39 feet from the lot line provides
ample distance between houses and thereforep it would be in keeping with the
intent of the By-Law and would not deviate too greatly from the zoning require-
ments.
Very truly yourst
