Conditions of variance - to be
on p laced plan
1 . That the premises be used only for professional offices ,
real estate offices , and insurance offices .
2 . That the first fifteen feet of the total set back abutting
the residential district shall remain open and green , be
suitably landscaped , unbuilt upon , unpaved , and not parked
upon .
3. That the variance is effective only upon approval by the
Commonwealth of Massachusetts , Attorney General ' s Office ,
of the Zoning By-Law Amendment as voted at the 1981 Town
Meeting.

Dear Mr . Long :
The Board of Appeals held a public hearing on Monday evening,
May 11 , 1981 upon the application of James P . Gordon . The
hearing was duly advertised in the North Andover Citizen on
April 23 and 30 , 1981 and all abutters were notified by regular
mail . The following Board members were present and voting :
Frank Serio , Jr . , Chairman ; Alfred E . Frizelle , Esq . , Vice-
Chairman ; William J . Sullivan ; Augustine W . Nickerson ; and
Raymond A . Vivenzio , Esq .
The petitioner seeks a variance from the provisions of Section 7 ,
Paragraph 7. 3 of the Zoning By-Law to enable the construction
of an office building with less than the required front set-back
on the premises located at the North side of Turnpike Street
as shown on the plan accompanying the petition .
The petitioner introduced evidence showing the size and shape of
the lot prohibited compliance with the provisions of the By-Law .
Upon a motion made by Mr. Frizelle and seconded by Mr . Sullivan ,
it was voted unanimously to grant the variance subject to the
following conditions :
1 . That the premises be used only for professional offices ,
real estate offices, and insurance offices .

The Board finds that the unique size and shape of the lot makes
it impossible to use the land for the allowed use , and, therefore ,
is a hardship pursuant to the provisions of the Zoning By-Law .
The Board further finds that all other requirements of Section
10 . 4 of the Zoning By-Law have been satisfied .
