Gourley, Jr. Premises Affected: 1740 Turnpike Street Mr. Daniel Long, Town Clerk Town Office Building North Andover, Mass . 01845 Dear Mr. Long: The Board of Appeals held a public hearing on Monday evening, February 14, 1983 upon the application of Russell W. Gourley, Jr. The hearing was advertised in the North Andover Citizen on January 27 and February 3, 1983 and all abutters were noti- fied by regular mail. The following members were present and voting: Frank Serio, Jr. , Chairman; Alfred E. Frizelle, Esq. , Vice Chairman; Richard J. Trepanier, Esq. , Clerk Augustine W. Nickerson; and Walter F. Soule. The petitioner seeks a variance from the provisions of Section 7 , Paragraph 7. 3 and Table 2 of the Zoning By Law to permit relief from the front setback requirement in order to construct a new office building on the premises located at 1740 Turnpike Street. The petitioner testified that the land is under agreement for purchase and he proposes to construct a 6 ,000 square foot admin- istrative dministrative office with an additional 20% for future expansion for use by the Girl Scouts Council, Spar and Spindle. A previous variance allowed relief from the area requirement as well as the side and rear setback requirements . RECEIVED Petition No. 9 - 183 DANIEL LONG Russell W. Gourley, Jr. TUY f;L7RK February 24, 1983 NORTH A '='OVER Page 2 f 8 28 !Q 41 8M '83 Upon a motion made by Mr. Frizelle and seconded by Mr. Trepanier, the Board voted unanimously to grant the variance subject to the following conditions ; 1. That the variance is limited solely to construction by or on behalf of the Girl Scout Council (Spar and Spindle) ; 2. That there be forty-one parking spaces ; 3. That the plan be revised in accordance with the Board's re- quirements for signature and be submitted no later than Wed- nesday, February 23, 1983. Otherwise, the Board's decision will not be placed on file with the Town Clerk. The Board finds that a literal enforcement of the Zoning By Law would create a hardship and that relief may granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent and purpose of the Zoning By Law. The unique size and shape of the parcel constitutes a hardship under the Zoning By Law. The Board finds that Section 10'.4 of the Zoning By Law has been satisfied.
