Dear Sir: A public hearing was held by the Beard of Appeals on October 18, 1976 upon application of John W. Graham who requested a variation of Section 6.3 and 'Fable 2 of the Zoning By-Law so as to permit a variance from the side setback requirement as shown on a plan of land located at 5 Magnolia Drive. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Vioe-Chairman; Louis DiFruscio, Clerk; Ralph R. Joyce; and Assoc. Member, Stephen R. Doherty. The hearing was advertised in the Lawrance Eagle-Tribune on October 2 and 9, 1976 and all abutters were duly notified by regular mail. The variance requested was to enable Mr. Graham to construct an addition to his existing dwelling and consisted of 3-4 ft. under the By-Law requirement of 15 ft. There were no objections from abutters. On a motion made by Assoc. Member, Stephen Doherty, seconded by Louis DiFruscio it was voted unanimously to GRANT the variance requested. The Board, in granting the variance pursuant to Sec. 9.5 of the By-Law, has determined that each of the requirements set forth therein have been met which will be discussed further herein. Mr. Graham has requested a variance of approximately 4 feet on the sideline of his property to enable the construction of a family room. At present, a porch is erected at the location but does not extend to the edge of the dwelling. The unique position of the dwelling on the lot in relation to the street and the abutting land precludes the positioning of the addition at another location. Due to the unique- ness of the position of the dwelling on the lot it creates a hardship to the owner, Mr. Graham, which the Board has determined to be substantial in light of the economic John W, Graham Decision —2— conditions at present which would require him to construct the addition in some other manner or to forego construction and bear with thes lvs of theconal a t" adds area required for his family. The granting of this variance will not create a substantial detriment to the public good and will not nullify nor derogate from the intent and purpose of the By—Law. The Board has given great weight to the opinion expressed by the abutter to the property, Dr. Eugene Beliveau, who was recorded in favor of the petition and, further, to the 'character of the neighborhood.
