Decision — Disapproval
Definitive Plan of Land
Gray Wood Estates dated
12/27/85, rev. 3/22/86
1 . Applicant has not provided a fifty (50) foot roadway width from
Gray Street through to station 22 + 75. In accordance with the
Planning Board' s Rules and Regulations, Section IV, 4.2.a,
street width shall be a minimum of 50 feet and the applicant
can provide for proper width since he owns land along one side
of the roadway or the other. Roadway widening easement is not
sufficient in the opinion of the Board to provide proper
access-egress, maintenance of the roadway and proper side
shoulders for the health, safety and welfare of the proposed
dwellings. For lessening congestion in such ways that will be
safe and convenient for travel, for reducing danger in the
operation of motor vehicles, for securing safety in the case of
fire or other emergencies, for insuring compliance with the
applicable zoning ordinances, for securing adequate provision
for water, sewerage, drainage, electric utilities and other
requirements in a subdivision.
2. The proposed roadway alignment at the intersection of Gray
Street does not provide the proper setbacks in the designated
Residence 2 district in Table 2 of the Zoning Bylaw for the
existing dwelling.
3. Applicant has not demonstrated how to construct the roadway for
its full width in areas of cut and fill without encroachment
onto land of abutters to the East from station 2 + 0 through to
station 15 + 50. The topographic plans show side slopes which
contradict the typical roadway cross section on the plans and
in accordance with the Planning Board's Rules and Regulations.
4. The applicant has not complied with the Board of Health
Regulations (see correspondence dated 1/15/86, 2/24/86 and
3/24/8'6) .
- Applicant has not fully demonstrated how dwelling and related
on-site sanitary leaching fields shall be designed and
constructed to protect and secure adequate provisions for
sewerage and drainage and ensuring sanitary conditions.
- Applicant has not provided information as required under Sec.
II, B,10; applicant has not provided locations of test pits l
through 16, no test pit or percolation data has been provided
for lots 5 through 9 inclusive.
Due to the close proximity of the wetlands to proposed
leacrhing fields and the high spring water table and not
withstanding the fact that some proposed leaching fields do
not meet the specifications of Title 5, the State Sanitary
Code, Regulation 3. 7, in its jurisdiction of ensuring certain

slope requirements for the design and construction of on-site
leaching fields and certain minimum distances from subsurface
drains and not withstanding that the Town of North Andover ' s
Planning Board' s Rules and Regulations, Section II,B, 3
states, "No land shall be subdivided unless it is of such
character that it can be used for building purposes without
danger to health and safety. No land shall be subdivided
unless the subdivision plan shall provide means of drainage
and sanitary sewerage disposal adequate in the opinion of the
Board to fully protect the public health."
- The Planning Board is of the opinion that lots 2, 3,4, 7,8, 12
and 13 shall be considered non buildable lots and shall
remain as open space to protect the integrity of the
wetlands, to ensure against additional flooding of existing
residents on Penni Lane and on land of the North Andover
Improvement Society and to protect the health of residents of
the Town of North Andover.
5. The Planning Board will not grant the applicant a waiver of
Strict compliance under M.G.L. Chapter 40A, Section 81-R and
Section IV.A.4.a and II .B.S.a concerning the length of Dead
End Streets in the Rules, specifically that which is designated
Stiles Street.
6. The applicant has not demonstrated compliance with the Rules of
the Planning Board, specifically Section III,B, l,d,e and
Section III, B, 3,k,m,n and p.
7. The subdivision plans do not indicate locations of stone bound
monuments in accordance with Sec. V. L, throughout the
subdivision.
8. The subdivision plans do not indicate pipe sizes into or out of
the proposed detention pond. Insufficient detail has been
shown to fully depict and demonstrate how the proposed ponding
area will be constructed, dikes or berm, excavated and type of
finish , surface. Applicant should have prcwided detailed
cross-sections with spring water tables and detailed the
proposed activity with proper side slopes from the roadway and
edge of wetlands and shown how the public safety would have
been protected to prevent vehicles from entering said pond.
- The Planning Board is of the opinion that the drainage
analysis as submitted by the applicant which does not
sufficiently detail the existing and proposed watersheds and
has not properly safeguarded against further flooding of the
wetland adjacent to the Penni Lane residences.
- No flood plain elevations have been submitted or delineated
on the plans.
8. The subdivision plans as submitted proposed driveways across
the vegetated wetlands to serve lots 7 and 8, the Planning
Board is of the opinion that detailed cross sections should
have been submitted to ensure proper side slope protection to
preven# the integrity of the slopes, wetland and driveways. No
data was submitted as to drainagle calculations or size of
proposed drain pipe under the driveways to ensure against
flooding and overlapping of the proposed driveways. No data
was submitted regarding the depth of peat in the driveway
crossing nor detailed provisions to show a contractor how to
preperly construct said crossing to protect the integrity of
the driveway.
9. A Notice of Intent has not been filed with the North Andover
Conservation Commission as required under Chapter 131, Wetlands
Protection Act and the local Conservation Commission' s
regulations.
- In accordance with the Conservation Commission' s letter dated
January 23, 1986:
o There is a possibility that the wetland boundaries are
inaccurate. If this is so then several lots would be
unbuildable.
o There is a discrepancy on a wetland boundary between IEP
and Christiansen Engineering on lots 12 and 13.
o Wetland replacement plan is required for lots 7 and 8.
o Off site wetlands need to be shown north of lot 7 and 6.
10. Applicant has not provided the Planning Board with any detail
of the proposed steel bridge to allow for proper analysis by
the Town of North Andover to ensure the safety, health and
welfare for the inhabitants of the Town of North Andover. The
Planning Board is of the opinion that such structural detail be
submitted prior to the approval of a subdivision that proposes
to serve residential dwellings with fire and police protection
and other related services incident to residences . If a
proposed bridge were to be built, what is the effect of
removing the existing drain pipe and roadway that presently
serves as flood control devices. No data regarding that matter
has been submitted to the Planning Board.
11. No Datum for the existing bench marks have been submitted. In
accordance with the rules and regulations, this subdivision
must be on the same datum as the Penni Lane subdivision to
allow the Planning Board to have reference to the watershed and
flood elevations of the mutual wetland areas. Bench marks
should have been established throughout the subdivision in
permanent locations. The Planning Board is of the opinion that
wooden stakes set in the roadway, leaching areas or proposed
house locations would be destroyed as soon as any construction
starts and are not considered permanent.
12. No documentation has been submitted to the Planning Board which
indicates the status or ownership of Stiles Street and the
applicants right to access said street.

INTRODUCTION

Gray Wood Estates is a proposed 22.5 acre subdivision
located in the southwest section of North Andover',
Massachusetts. The site is located to the north of Gray
Street, just west of Penni Lane (See figure 1A) . The
subdivision will contain 13 building lots. Access to the
' project site will be provided by Stiles Streets an existing
street that will be improved and reconstructed from its

Section V
' Environmental Report
' This Statement of Environmental Impact is presented by first giving
the specific wording of the subsection as given in Part III-B-5 of
the Rules and Regulations followed by the applicant's response to that
' specific request for information.
Part III b 5.
The statement of Environmental Impact should include the following:
a) A set of plans at uniform scale shall be submitted in
conjunction with the Environmental Impact Statement, encompassing
the entire subdivision on a single sheet not larger that 42" by
60" showing the following:
(1) Present and proposed topography at two (2) foot
intervals, with graphic drainage analysis, location of
' existing structures, including fences and walls;
See design sheets 5, 6 and 7
(2) Vegetative cover analysis, including identification of
general cover type, (wooded, cropland brush, wetland, etc.),
location of all major tree groupings, plus other outstanding
trees or other botanical features, important wildlife
habitats, and identification of areas not to be disturbed by
' construction;
See design sheets 5, 6 and 7; Lot 1 shown on sheet 5
' consists of meadow and orchard. Lots 2, 3 and 4 are
wooded but have recently beencutfor lumber. A large
portion of lots 2, 3 and 4 are wetlands as shown by the
' wetlands line. Lots 13, 12, 11 and 10 shown on sheet 6
are fields with a large portion of the lots being
wetland. Lots 5 and 6 are forested. Lots 7, 8 and 9
consists of both forest and wetland.
(3) Approximate surface and subsurface water level and
' seasonal high ground water mark;
Subsurface water levels are generally l'6" - 6'0" from
the surface. The surface water ranges from elevation
69 92 in the west of the site to 90 - 94 on the east
of the site.

(4) Soil types based un U.S.D.A Soils study and location of
soil percolation. tests.
' The soil types are discussed in section VII of the
definitive plan application.
b) Physical Environment
' (1) Describe the general physical conditions of the site,
•. including amounts and varieties of vegetation, general
' topography, unusual geologic, scenic, and historical
features, trails and open space links and indigenous
wildlife;
Stiles Street is an existing undeveloped road bounded
by two stone walls. An existing are house is at the
westerly side of Stiles Street at its intersection with
Gray Road. Stiles proceeds generally in a northerly
direction. The land to the west of Stiles Street, for
a distance of 500 feet, is part of an orchard. From
' the point where the orchard ends to a point where
Stiles Street crosses a stream, (approximately station
14) the land was until recently wooded. A lumbering
operation has cleared most of the land up to the large
' wetlands that is on the site. All of the land to the
east of Stiles Street, in this same area has been
subdivided and is the backyards of the homes on Penni
Lane.
Proceeding from the stream along Stiles Street for
approximately 250 feet the applicant doesn't own any
land on either side of the road. At approximately
station 16 + 50 the applicants land is on the easterly
portion of Stiles Street. The land on the westerly
' side of the road' is undeveloped. The applicants land
from station 14 + 50 to approximately sttation 23 + 00
is open meadow adjoining the road and wooded at the
wetlands line. The remainder of the property is
wooded.
' 2) Describe how the project will effect these features,
The land's contours will be reshaped where the houses .
will be built and where the driveways will be laid. In
addition, some regrading for Stiles Street will be
necessary. This recontouring will have an impact but
we have attempted to recontour the land following
existing contours.
' Approxiamtely 3,480 square feet of wetlands will be
filled. These wetlands will be filled for the
driveways to lots 7 and 8.
Much of the forest cover of the site will be removed
because of construction.
3) Provide a complete physical description of the project,
and relationship to surrounding area.
Thirteen houses will be built and approximately 2500
feet of roadway will be constructed. Water, sewer and
' drain lines will be laid.
The lots range in size from 1 to 3 acres.
' The project is consistent with the area's prevailing
land use of residential housing.
' c) Surface, Water, and Soils
' (1) Describe the location, extent, and type of existing
water and wetlands, including existing surface drainage
characteristics, both within and adjacent to the project;
A large portion of the site area is wetlands and will
for the most part be untouched by the project. Details
of the drainage can be found in the hydrology section
' of this report.
(2) Describe the methods to be used during construction to
control erosion and sedimentation; eg., use of sediment
basins and type of mulching, matting, or temporary
vegetation; describe approximate size and location of land
' to be cleared at, any given time and length of time .and
exposure; covering of soil stockpikes; and other control
methods used. Evalaute the effectiveness of proposed
' methods on the site and on the surrounding areas,
Erosion and sedimentation will be controlled by the use
' of fabric fencing, sedimentation areas and hay bales.
The location of fabric fencing is also shown on the
plans. Two rows of staked hale bales will be placed
' around each completed catch basin. See the erosion and G
sedimentation control plan included in this report.

3) Describe the permanent methods to be used to control
' erosion and sedimentation. Include description of
a. any areas subject to flooding or ponding,
b. proposed surface drainage system,
c. proposed land grading and permanent vegetative cover,
d. methods to be used to protect existing vegetation,
e. the relationship of the development to the topography,
1 f, any proposed alterations of shore lines, marshes or
seasonal wet areas,
g., any existing or proposed flood control or wetland
' easements,
h. estimated increase of peak run—off caused by altered
surface conditions, and methods used *to mitigate any
impact and/or return water to the soil,

Erosion and sedimentation will be controlled on a
L ' permanent basis by the re-vegetation of all areas
disturbed by construction. According to the Planning
Board Regulations, the road shoulder will be loamed
and seeded. In areas of the homes, lawns will be
planted. For further discussion of drainage and
siltation, see Sections E and I of'this report.
' 4) Completely describe sewage disposal methods. Evaluate
impact of disposal methods on surface 'water, soils, and
' vegetation;
Sewage will be disposed of in septic systems which will
' be design according to state and town standards.
d) Subsurface Conditions.
(1) Describe any limitations on proposed project caused by
subsurface soil and water conditions, and methods to be used
' to overcome them;
Subsurface conditions that could be a limitation to the
project include high ground water (1'-6" below the
surface) . This will effect the elevation of the
foundations of the proposed houses and septic systems
construction. In areas with a high water table,
foundations can be constructed so that they are
completely above the ground water level. Septic
' systems will be raised.
(2) Describe procedures and findings of percolation tests
' conducted on the site;
Percolation tests were conducted on the site and the
' results are in this report in another section.

' (3) Evaluate impact of sewage disposal methods on quality
of subsurface water;
Because septic systems will be designed to state
standards, they will not have an impact on ground water
quality.
e) Town Services
(1) Describe estimated traffic flow at peak periods and
proposed circulation pattern;
The traffic flow per day is estimated to be 156
vehicles. The peak flow would be 65 vehicles per hour.

' (2) Describe locations and number of vehicles accommodated
in parking areas;
Each home will have a driveway and most will have a
garage. Each home can accommodate at least 3 vehicles.

' (3) Describe effect of project on police and fire
protection services;
The construction of new roads and homes will increase
the work of the Police Department and Fire Department.
' (4) Describe effect of project on Public Works Department;
The project will increase the work of the Public Works
Department.
(5) Describe effect of project on educational services;
The project will eventually increase the number of
' school age children in North Andover.
' (6) Describe effect of project on the town water supply and
distribution system;
The town water supply will be expanded as a result of
' the project.
' (7) Describe effect of project on the town sewer system.
The project will not effect the town sewer system.

(1) Summarize briefly environmental impact on entire town
' with supporting reasons.
The project will cause an increase in work for the
' public fire and highway departments. The home
construction will cause the removal of forest and
meadow. The subdivision will also mean more children
for the school systems.

and an increase in the human resources that the
' families that buy the homes will bring_ to North
Andover.

Drainage Analysis
The purpose of the analysis presented here was to:
' 1.) Develop a hydrologic model that describes the existing
drainage patterns and flow for the project site.
2.) To predict the effect of the project on the flow
' characteristics of the site.
' 3.) To develop a system of drainage structures and controls that

' would mitigate the effect of the project.
' The major hydrologic feature of the project site is a stream that
' has its source near Boston Hill, flows through the project site, and
discharges into a large wetland and pond area (at control point A in
' Figure 1) to the Skug River. The watershed area that contributes to
the stream flow is shown in Figure 1. The project area is shown as
the shaded portion of drainage areas 4,5,6 and 12.
The existing 100 year stream flows were predicted using a
methodology that combines the SCS Modified Soil Complex Cover Method,
methods presented in National Engineering Handbook; Section 4:
tHydrology , a type II stream as described by the National Weather
' Service, Hydrologic Determination of Water Wal' Areas for the Design
of Drainage Structures in Small Drainage Basins by V.T. Chow, and our
own computer model. A copy of the SCS soil conditions for the
' drainage area is shown in Figure 2. Using these soil types, CN values
as developed by the SCS, drainage area acreage measured by planimeter
' and the type II storm intensities, we were able to develop a
hydrograph for each drainage area and add the hydrographs together for
' a combined flow to CPA. See attached calculations and computer
' printouts.
' Areas 1-11, 13 and 14 flow to control part A through the stream.
' Area 12 flows overland directly to the wetland.
' For the proposed conditions, only areas 4,5,6 and 12 are effected
by the project. The CN values, lag times, and times of consentration
' were adjusted and all of the hydrographs rerun. The results are
attached.
' The analysis shows that there are two areas of concern:
1 .) Stream flow under and over Stiles Street.
' 2.) Peak off site flow.
The stream flow to Stiles Street at CPA shows an increase from
' 370 cfs to 376 cfs. The combined flow to the wetland shows an
' increase from 398.5 to 399 cfs. The total value increase to the
wetlands would be 20,000 cubic feet.
We are proposing to install a bridge over Stiles Street at the
stream to allow it to flow as it presently does; through a 30" pipe
and overtopping the road during storms. While the 30" pipe will stay
as it is, the storm flow spillway over Stiles Street will be reshaped
' to accomodate the bridge design. The following calculations show that
the flood level of the stream and hence the adjoining wetland will not
be changed by the project.
' As can be seen from the attached calculations the project will
' have little effect on the area wide hydrology, however we are
proposing a detention pond of approximately 20,000 cubic feet that
will collect road drainage and maintain the rate of flow off site as
compared to existing flows. This pond will provide storage for the
increased volume the project generates as well as reducing the peak
flow. It will also act as a siltation basin to prevent silt and road
salts from reaching the wetlands.
' We believe that the calculations presented here show that the
project will not cause any flooding or drainage problems down stream,
' and as designed meet Planning Board criteria.
Also attached are the calculations that show that the drainage
tstructures are adequate for handling the designed flow.
' The previous hydrograph shows that the total flow from the
drainage area would increase from 398.5 to 399.0 as a result of the
' project. To correct this we propose to take the entire drainage of
tthe southernly portion of Stiles Street to a detention pond.- The
following hydrographs show the street and adjoining drainage patterns.

' The wetlands on site will be protected from siltation damage by
siltation fence. Fence backed by staked hay bales will surround the
working area and will be placed before work is to begin. The fence
.will be inspected by the engineer and both the Conservation Commission
' and Planning Board to insure proper installation. The fence will
remain in place until the slopes have been stabilized with loam and
seed. All silt will be removed from the area before removal of the
fence. Periodic inspections will be conducted by the engineer to make
sure that the fence is in good working condition.
' An area of 3480 SF of wetlands will be filled to provide access
(driveways) to lots 7 and 8 of the subdivision. A replacement area of
3980 SF will be provided to compensate for the loss. These areas are
shown on sheets 6 and 7 of the definitive' subdivision plans.

Access to the proposed site will be provided by Stiles Street. Stiles
Street intersects Gray Street at 750, and at a grade of 1.5%. The
' site distance from Stiles Street in eitherdirection is-approximatetly
220 feet. This distance provides for safe stopping for speeds up to
32 miles per hour under wet driving conditions on Gray Street, a
narrow winding road.

SILTATION AND EROSION CONTROL

Siltation and erosion control
Erosion and siltation will be controlled in the following manner:
-, As soon as the roadway right of way is cleared of trees and all of the
stumps are removed, siltation fence and hay bales should be placed
between the roadway and any sensitive areas. Erosion control should
also be placed at the bottom of all slopes in cut or fill. This form
' of erosion control is illustrated in figure 4: Sedimentation control
detail.
Crushed stone should be placed at the entrance of the roadway over the
full width of the cleared area for a distance of 50 feet to a depth of
4 inches to provide erosion control for the uphill grade into the
project.
1 When the drainage structures are installed in the roadway, the frames
and grates should be mortared and set to finish grade immediately. On
many projects the manholes and catch basins are left low and uncovered
after installation, and act as collectors of sediment and runoff. By
setting the frames and grates to finish grade they will be higher than
' the surrounding roadway until it is paved. This will prevent water
and sediment from entering the drainage system before the roadway is
paved. Temporary siltation ponds should be constructed at the
discharge end of all drain pipes, as shown on figure 5: Siltation
' pond detail. Hay bales should be placed around the catch basin inlets
after the roadway is paved, and should remain in place until the
shoulders and side slopes are stabilized with sufficient vegetation to
prevent erosion.
All slopes in construction areas throughout the site should be seeded
and mulched (or hydro seeded) as soon as construction in the areas is
complete. The stabilization and seeding of the slopes should not be
left as the last item of work on the project.
