'_:_•:`'- z c to of 0f tipis Notice oi-a - in the Office of the Town x r Clerk. u y'SSACNU5 TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS James Hartigan * Petition >f: 120-88 15 Appaloosa Lane Hamilton, MA 01982 * DECISION The Board of Appeals held a public hearing on April 12, 1988 on the application of James Hartigan requesting a variance from the requirements of Section 7, Paragraph 7.3 and Table 2 of the Zoning ByLaw so as to permit reduction of the setback requirement of 100' to 75' on the premises located at Lot 6C, Turnpike Street. The following members were present and voting: Frank Serio, Jr. , Chair- man, Augustine Nickerson, Clerk, William Sullivan, Walter Soule and Raymond Vivenzio. The hearing was advertised in the North Andover Citizen on February 11 and February 18, 1988 and all abutters were notified by regular mail Upon a motion made by Mr. Vivenzio and seconded by Mr. Soule, the Board voted, unanimously, to GRANT the variance as requested. The Board finds that the petitioner has satisfied the provisions of Section 10, Paragraph 10.4 of the Zoning ByLaw and the granting of this variance in particular will not derogate from the intent and purpose of the ByLaw nor will it adversely affect the neighborhood. Granting variance would provide relief to petitioner by eliminating necessity of placing proposed home on the steeper slope to the rear of the lot . Moving home ahead 25 feet would more readily accom- plish slope requirements of sewage disposal system and foundation backfilling. Having the foundation closer to the front of the lot would also provide more rear yard area and eliminate removing more trees than necessary from the side and rear of home . Turnpike Street ( Rt . 114 ) is laid out 80 feet wide although the pavement is only 60 feet wide .
