Hoyt y Dear Sir: Upon application of Walter P. Hoyt and Lillian M. Hoyt. 80 Boston Road, North Andover, Massachusetts, applying for a variance from the requirements of the Zoning Ordinance of North Andover, Massachusetts, ander Section 6.33, the Zoning Board of Appeals of North Andover, Massachusetts, heard same application and petition on the evening of September 19, 1966, at 7:30 P.M. . The hearing was held in the Town Hall facilities. Members present and voting were John J. Shields, Chairman, James Deyo, Secretary, Daniel T. O'Leary, Arthur Drtond, and Donald Scott. Representing the applicant was Attorney Donald F. Smith. There were no objectors heard or registered. The petition of the applicant was advertised in the Lawrence Eagle Tribune under date of September 3 and September 12, 1966. All abutters were duly notified of this hearing by certified mail. Attorney Donald F. Smith, appearing for the applicants pleaded the justification of the request for a minor deviation from the applicable zoning requirements as shown on a plan of land wherein the applicant desires to sub-divide a large parcel of land into four house lots. Lot 3, the subject lot, contained gross land area in excess of the Zoning By-Law requirements and laded 7.39 feet of street frontage fundamentally due to an irregularity in the lot line wherein 26 feet had been taken from the street front line many years ago. Attorney Smith fur- ther noted that Lot 1 contained mare than 200% of the required land area and that Lot 2 had substantially greater amount of land than required, that Lots 1 and 2 did possess the minimum. DECISIC9 2 - Hoyt street frontage, and that in total land area qualifying from five to six lots, had been reduced by the petitioner to four lots. Principally referring to the three lots on Sullivan Road, Attorney Smith indicated that a varianee of the minute differential required on street frontage would not derogate from the intent and purpose of the By-Law nor would it be detrimental to the neighborhood, and that failure of a favor- able decision would, in effect, produce a hardship, both fi- nancial and otherwise, to his client. The application was taken ander advisement by vote. In Board action under advisement period, it was moved and seconded and became a unanimous vote of the entire Board that the subject application be granted as a variance to the requirement of 1501 street frontage for Lot 3, and approved with W.611 as shown on a plan of land "William P. Hoyt, No. Andover, Mass. ,," dated September 190 1966, Robert E. Anderson, Inc. , C.E.. The principal reasons for granting this variance are: a) That to deny the application would create a severe hardship, both financial and otherwise, upon the present owner; b) That approving of said variance would not derogate from the intent and purpose of the existing Zoning By-Law; c) That the granting of said variance would not be detri- mental nor adversely affect the neighborhood influences or derogate from neighborhood values; d) That to the passer-by, no evidence of street frontage variance would be noticeably observable. Andover, MA 01845 * DECISION The Board of Appeals held a public hearing on Tuesday evening, May 1, 1990 upon the application of Walter P. Hoyt requesting a variance from the requirements of Section 7, Paragraph 7.3 and Table 2 of the Zoning Bylaw so as to permit a garage built in 1983, to stay 13.5' from the side lot line, not 30' as required, on the premises located at 109 Sullivan Street. The following members were present and voting: Frank Serio, Jr. , Chairman, Augustine Nickerson, Clerk, Walter Soule, Raymond Vivenzio and Louis Rissin. The hearing was advertised in the North Andover Citizen on April 12, 1990 and April 19, 1990 and all abutters were notified by regular mail. Upon a motion made by Mr. Vivenzio and seconded by Mr. Nickerson, the Board voted, unanimously, to GRANT the variance as requested. The Board finds that this is a justifiable request because the petitioner tried to meet all the requirements of the bylaws and obtained a valid Building Permit from the Town at the time the garage was built in 1983. The Board finds that the petitioner has satisfied the provisions of Section 10 Paragraph 10.4 of the Zoning Bylaw and that leaving the garage in its present location will not derogate from the intent and purpose of the Zoning Bylaw nor will it adversely affect the neighborhood.
