J. Albert Bradley represented the petitioners. There were eighteen people present. Atty. Richard Sullivan represented a group of abutters along Waverly Read. They were concerned as to whether or not there xould be a roadway from Waverly Read in to the Shay property and also requested the pati— timer not to include a corner portion of the area near Waverly Road in time re—zoning area. There were no other objections. In executive session, time Beard voted as follows Air. Gilman mad* a notion to APPROVE the petition and Mr. Farley seconded the motion. Time vote was uaasnimous. Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening, January 9, 1967 at the Town Office Building. Members present and voting werez William Chepulis, Chairman; Robert J. Burke, Vice Chairman; Howard L. Gilman, Secretary; James M. Bannan and George B. Farley. JOHN P. & KASTANT SHAY petitioned to amend the North Andover Zoning BY-Law and the Zoning Map of the Town by changing from; Country Residential to General Business a parcel of land containing 6-85/100 acres more or less, located on Winthrop Avenue at its intersection with the westerly line of Waverly Road and adjacent to land formerly of the Den Rock Drive-In Theatre. Atty. J. Albert Bradley represented the petitioners. There were over thirty people present and the hearing was held at the Fire Station Meeting Room. The petitioners said they had no present plans for the area but that it would be an advantage to have the entire area business since it was not desirable land for residential development. Atty. Richard Sullivan represented Henry Berube as opposed to the re-zoning. A large number of other residents along Waverly Road were also opposed. They were concerned about the traffic hazard already existing at the intersection of Winthrop Avenue and Waverly Road and about how much worse it could get. They think the area should remain residential since the value of their homes would be affected by a business area being close by. The Board held a special meeting on January 23rd to discuss and vote on the petition. Mr. Bannan made a motion to recommend disapproval of the re-zoning of this parcel of land. Mr. Burke seconded the motion and the vote was unanimous. The Board gave the following reasons for disapprovals 1. There is no apparent need for re-zoning since there are no plans for the use of this site. 2. This is a residential area and the Board feels it should remain that way. 3.
