TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS March 21, 1984 Mr. Daniel' Long, Town Clerk Shell-' Oil Co. Town Office Building 17 Mass. Avenue North Andover, Mass. Petition No. 11-184 Dear Mr . Long: The Board of Appeal's held a public- hearing on Monday evening, March 12, 1984 upon the application of Shell Oil' Co. The hearing was advertised in the North Andover Citizen on February 23 and March 1, 1984 and all abutters were notified by regular mail'. The following members were present and voting: Alfred E. Frizelle, Esq. , Vice Chairman; William J. Sullivan; Augustine W. Nickerson; and Associate Members Maurice S. Foulds and Raymond A. Vivenzio, Esq. The petition seeks a variance from the provisions of Section 7 Paragraph 7.3 and Table 2 of the Zoning by Law so as to permit relief from the front yard setback requirement to allow the the extension of a pump and erection of a canopy on premises located at 17 Mass. Avenue located in the G-B zoning district. Mr . Charles Ford, Field Engineer, testified that the proposal" is to construct a second island and a 'canopy at a height of seventeen feet (17' ) which will' be lighted down. The front yard setback requirement will- not be met. The business has expanded and more mobility is needed. A sign is proposed on the end toward Lawrence and Route 495. Avenue ( 34 PM 184 Petition No. ll-'84 March 21, 1984 Page 2 Upon a motion made by Mr. Sullivan and seconded by Mr. Nickerson, the Board voted unanimously- to grant the variance subject to the following conditions: 1. That there be no signs or other advertising on the canopy, on either side, front, or rear,, or on the roof. 2. That the lighting be surface mounted underneath the canopy, facing down. In granting the variance, the Board finds that Section 10.4 of the Zoning By Law has been satisfied. In particular, the Board finds that denial' of the variance would create a hardship to the petitioner 's business since it could not expand. Said variance, in the opinion of the Board, does not cteate a detriment to the public' good nor does it nullify from the intent and purpose of the Zoning By Law.
