Dear sirs The folloving petition was heard at a meeting of the Board of Appeals ox Ymmday evening3 January 10, 1966 at the Town Office Building. Members present and voting were$ Daniel T. O'Leary, Chairman; William Norton, Secretary; trtbur Drummond, John J. Shields and James Deyo, RICBARD A. SBE'LLNUT, ADM., FSTATB OF ALIO )L SHELIM requested a variation of See. 6.31 and 7.23 of the Zoning By-law so as to permit the subdivision of a lot into two lots having less than 12,500 square feet, on the premises located at the east side of Chick- ering Road, at the intersection of Bay State Road. This public hearing was advertised im the Bugle—Tribume on December 27s 1965 and January 3, 1966. All abutters were dully notified by certified mail of this hearing. Atty. Harold Morley represented the petitioner, who was also present. There were six ' abutters present who just asked questions of the petitioners, but were not opposed. Atty. Morley explained that the petition was just a matter of foss that needed the Board's approval for legal purposes in order to clarify the deed and to record the two lots. A house is presently located on one lot and the other let would be avail— able for a single family residence. In Executive session, after thorough discussion, Nr. Shields made a motion to GRW the variance. Mr. Drummond seconded the motion and the vote was vasnimoun. The Board voted to grant the variance for the following reasons a. The proposed lots would not be in derogation to the neighborhood. b. There exist certain conditions, especially affecting the parcel in question, which do not generally affect the entire zoning district in which the parcel is located. c. The Board seem no derogation to abutting properties or to existing neighborhood influences. d. To deny the said petition would result is a substantial hardship, financial or otherwise.
