Dear Mr. LYonss A meeting of the Board of Appeals was held om Monday, December 19, 1960 at SsOO PM at the Toa Office Building on the application of Sherwood Homes, Inc. requesting a variation of Section 6 Paragraph 6.31 of the Zoning By Lax so as to permit the division of four lots into two lots in accordance with procedure provided under Paragraph 6.62 on the promises located at the East side of Patroit Street at the corner of Belmont and Sargent Streets. Members present and voting wares Daniel T. O'Leary, Chairman, Charles foster, Jr.., Secretary, Henry Lund, Robert Burke and Associate Member Harold Morley Jr. John Shields appeared for himself and pointed out by dividing these four lots into two lots they would contain at least 10..000 square feet. There was no opposition to the petition. Upon motion duly made and seconded, it was unanimously voted that the variance be granted subject to receiving a copy of the agreement to purchase this land. Mr. Sharma said imsmach as Mr. Shields tom-willing to have the lot 30 feet from the lot line, the Donovass were not objecting to this variance. There was no other opposition present. Lyons, Town Clerk Town Office Building North Andover, Mass, Dear Sir: Upon application of Sherwood Bones, Inc. to the North Andover Board of Appeals for a variation under Section 6.33 of the North Andover Zoning By Laws so as to permit the utilization of a parcel of land containing 16.88 acres but lacking ninimni street frontage, a public hearing was held on August 12, 1968 by the North Andover Board of Appeals. The hearing was held in the Town Hall facilities after having been advertised in the Lawrence Eagle Tribune on the dates July 27 and August 3, 1968 and with all abutters duly notified by certified mail. The members of the Board present and voting were: James A. Deyo, Chairman; Arthur Drummond, Secretary; Daniel T. O'Leary, Donald J. Scott and J. PhilipArsenault, Esq. The petition was presented by John J. Shields who stated that it was desired to have the property given the status of a legal lot. As the land now stood, it could not be used even though it was greatly in excess of the ainimirm area required because there was only 50 feet of frontage on a street. A building permit for any type of con- struction could not, and would not be issued in its present status. There were several abutters present who were principally concerned about possible deleterious drainage should the property be divided into say ten or more lots. To this query Mr. Shields stated that it was not his intention to subdivide the lot as if it were,he would be before the Planning Board not the Board of Appeals. He merely wanted the land recognized and given the status of a legal lot. Upon motion the petition was taken under advisement. Daring this period acme dis- cussion was devoted to the probable use of said land. There was additional discussion as to thether the land should more probably have been submitted to the Planning Board for subdivision but it was generally concluded that it was the perogative of the petitioner to do as he wished. • .Sherwood Homes, Inc. -2- September 11, 1968 On a motion by Mr. O'Leary and seconded by Mr. Scott, the petition was granted with member Arsenault voting against. The principal reasons for granting the variance and a condition are as follows Not 1./ Granting the variance would cause severe. hardship, financial or otherwise, to the petitioner in denying him any use of said land. 2. The use of a 50 foot access to interior land is reasonably normal practice. 3. Granting the variance will not deviate from the intent and purpose of the Zoning By-Laws. The condition attached to this approval is that there be no structures within the lot erected within 50 feet of the access lane that would block access to the remainder of said lot. Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening June 5, 1967 at the Town Office Building and the Fire Station Meeting Room. Members present and voting were: William Chepulis, Jr., Chairmen; Robert J. Burke, Vice Chairman; Howard Gilman, Secretary; James M. Bannan and George B. Farley. SFD HOMSS, Ili. petitioned to subdivide a parcel of land, 501 in width, lying on the northerly side of Rea Street between the properties of Barrett and Natali, and running 501 for a total of 3001 in length, and then comprising 7 lots, all con— taining in excess of the minimum 4!},000 sq. ft. lot requirements; containing X45,900 square feet, more or less. John J. Shields appeared on behalf of Sherwood Homes, Inc. This area comprises approximately 9 acres and is being subdivided into 7 lots, each lot containing in, excess of the minimum 44,000 sq. ft. lot requirements. There is a 5801 road with a 70t radius turnaround. Mr. Shields stated that the engineers had not completed the final definitive plans in time for the announced hearing. He further stated that the definitive plans would not differ from the preliminary plans available. Upon receiving this information, the Panning Board announced to all attending the hearing that, if there be no objection, the hearing would proceed as scheduled based upon the assumjrtion that there would be no significant difference between the preliminary plan and the definitive plan. There being no objection from the interested attendees, the bearing proceeded with the added announcement that the effective date of consideration of the petition would be the actual date of submission of the definitive plan, providing there were no differences as stipulated. Mr. Shields explained that there is a water problem in the area and that his sub- division will alleviate that problem. Several abutters spoke of the drainage problem, which was their main concern. Mr. Burke made a motion to take the petition under advisement. Mr. Farley seecoded the motion and the vote was unanimous. r .2_ itay 32, 1967 The definitive plan was duly submitted on June 121, 1967. A Special Meeting was held ton Saturday morning# June 17th at IOSOO A.M. in order to review the plans and discuss the petition in Executive Session. The Planning Board decreed that no significant difference existed between the preliminary plan discussed at the hearing and the definitive plan subsequently submitted. After considerable discussion, it was voted to request the subdivider to attend the neat meeting of the Board in order to discuss the extension of the roadway to the lot line and eliminating the turnaround. A Special Meeting was held on Tuesday evening, July 11, 1967 at 7s3O P.M. at which John J. Shields was present. A thorough discussion was held regarding the roadway. Mr. Burke made a motion to AFFRM the subdivision plans as presented to the Board, subject to the following conditions. Mr. Gilman seconded the motion. Mr. Burkes Mr. dilman and Mr. Parley voted in favor of the approval. Mr. Ghepulis and Mr. Bannan voted against the approval because they felt that the turnarolmd should extend to the lot line. Conditions 1. That the record owners of the subject land forthwith execute and record a "covenant running with the land", or otherwise provide security for the construction of ways and the installation of municipal services within said subdivision, all as progided by G.L. e. 41, p. 81-U. 2. That all such construction and installations shall in all respects conform to the governing rules and regulations of this Board. 3. That, as required by the North Andover Board of Health in its report to this Board, no building',or other structure shall be built or placed upon Lots as shorn on said Plan without the prior consent of said Board of Health. 11, That water and sewer will be according to the rales and regulations of the Board of Public Works. 5. That surface drains and street bounds meet be insta32.ed; the construction of streets and driveways shall be subject to the approval of the High g Department. 6. The roads must be hot-topped and proper street signs installed. 7. Approval is subject to the requirements of the Local and/or State Dept. of Public Health regarding sanitary disposal. systems. 8.
