Dear Mr. Long:
A public hearing was held by the Board of Appeals on September 17, 1979 upon application
of Wayne & Charlene Welch who requested a variation of Sec. 7.1, 7.3 & Table 2 of the
Zoning By-Law so as to permit variance from sideline and area requirement on the premises
located at 889 Johnson St. and shown on a plan of land dated August 1979. The following
members were present and voting: Frank Serio, Jr., Chairman.; Alfred E. Frizelle, Esq.,
Vice-Chairman; R. Louis DiFruscio, Clerk; James D. Noble, Jr.; and William J. Sullivan,
Assoc. Member.
The hearing was advertised in the North Andover Citizen on August 30 and September 6,,
1979 and all abutters were duly notified by regular mail.
At the hearing, evidence was introduced showing that the petitioners did not construct
the dwelling on the premises and, further, that a recent plot plan showed a difference
in area from the original plan. The petitioner stated that three engineers were engaged
to perform a survey. Each engineer differs as to the area and distance. The apparent
discrepancy results from the fact that one lot line is in a clump of trees and cannot
accurately be ascertained.
Upon motion made by Prizelle, seconded by Noble it was voted unanimously to GRANT the
variance. The Board has found that due to the unusual shape of the land a literal
enforcement of the By-Law would create a hardship on the petitioner. Further, the Board
finds that the relief sought can be granted without nullifying nor derogating from the
intent and purpose of the By-Law.
