Dear Sir:
A public hearing was held by the Board of Appeals on October 16, 1972 upon
application of ANTHONI T. WERTZ who requested a variation of Section 6.1 of the
Zoning By—Law so as to permit the division of a parcel of land into two lots, one
of which does not contain the required area on the premises located at the east
side of Wood Lane and known as 435 Wood Lane. The following ambers were present
and voting: J. Philip Arsenault, Chairman; Dr. Eugene A. Beliveau, Clerk; Arthur
Drummond, Frank Serio, Jr. and Associate Member Louis DiFruscio who sat in place
of regular member Kenneth Pickard.
The hearing was advertised in the Lawrence Eagle—Tribune on September 30 and
October 7, 1972 and all abutters were duly notified by regular mail.
Mrs Wertz appeared on his own behalf. He explained that when the land was purchased
16 years ago he thought that there was enough land for another house. Lot #1 is
approximately 400 feet less than the 129500 sq. ft. required; the lot meets frontage
requirements. There would be a financial hardship if he had to sell the area as one
lot. His residence is on one lot, which meets all of the zoning requirements, and
he has a buyer for the vacant lot. James Hurrell, the real estate dealer for this
property, explained that there are other lots in the area the same size or smaller.
There are sewerage facilities available. There were no abutters present and no
one else spoke.
The petition was taken under advisement and during this period was reviewed by the
Board. Mr. Serio made a motion to GRANT the variance; Dr. Beliveau seconded the
motion and the vote was 4-19 with Mr. Drummond voting no.
The Board found that the size of the lot was in keeping with the other lots in the
area and would not be in substantial derogation from the intent and purpose of the
Zoning By—Law.
