Andover, Massachusetts, applying for a variance from the re- quirements of the Zoning Ordinance of North Andover, Massa- chusetts, under Section 6.32, Paragraph 6, and Section 6.61, the Zoning Board of Appeals of forth Andover heard, same appli- cation and petition on the evening of July 11, 19660 at 7:30 P.M.. The hearing was heard in the Town gall facilities. Members present and voting were John J. Shields, Chairman, James Deyo, Secretary, Daniel T. OlLeary, ,Arthur Drummond, and Donald Scott. Representing the applicant was Attorney Charles W. Trombly. There were no objectors heard or registered. The petition of the applicant was advertised in the Lawrence Eagle Tribune under date of June 25 and July 22 1966. All abutters were duly notified of this hearing by certified mail. Persuant to the application, the consideration for a variance is predicated on the recording of a plan in 1961 converting five (5) lots, previously recorded, into three (3) lots known as A. B, and C. Attorney Charles W. Trombly pleaded the cause and developed, as shown on the plan of land submitted with said a plication, that there existed on an older recorded plan five (5) lots of land, and that in 1961 a plan of land was recorded in the North Essex Re- gistry of Deeds as Plan #431A; that the lots under consideration ranged from 8200 square feet to 12,500 square feet where the for- mer lots contained, typically, 6,000 to 8,000 square feet. It was further disclosed that in 1961, at the time of recording said plan, and acting in good faith, the petitioner or her agent did apply for Planning Board approval. The necessary indication on the plan was that the plan did not require sub-division control action. Y DECISION Page II Agnes Wildes Attorney Trombly further pointed out that in order to convey any one or all of these lots, a variance was sought confirming the plan recorded in 1961; further, that the lot adjacent to Lot A on the northwesterly side contains less than 7,000 square feet and was in existence prior to the adoption of the present Zoning By-Law. It was further developed that there were many lots in the immediate neighborhood of much less square foot area and street frontage than the subject lots. Three interested property owners of the neighborhood, not neves- sarily abutters, queried the frontage of Lot C on Cotuit Street and, when advised that Lot C contained 1251 street frontage, appeared well satisfied and had no objection. The petition was taken under advisement , During the period of advisement , it was determined that many ty- pical lots of the immediate neighborhood influence ranged from 6,000 to 8,000 square feet with several lots having approximately 60, frontage. Member Daniel OtLeary made a motion to grant the application. The motion was duly- seconded by Member Arthur Drummond, and the vote was unanimous to grant a variance on Lots A. B. and C as shown on a Plan of Land of Agnes Wildes, North Andover, Massachusetts, dated June, 1960, by Brasseur Associates of Haverhill, Massachu- setts, Registered Land Surveyors, The reasons for granting of subject variance are: a) That to deny the application would create a severe hard- ship, both financial and otherwise, upon the present ow- ner; b) That approving of said variance would not derogate from the intent and purpose of the existing Zoning By-Law; e) That the granting of said variance would not be detri- mental or adversely affect the neighborhood influences or derogate from the neighborhood values; d) That the combining of five (5) lots into three (3) lots reflected the most acceptable plan of good land planning and would result in no perceptible differential of the immediate neighborhood.
