'ds�cN°s� TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS May 16, 1985 Mr. Daniel Long, Town Clerk Miele Realty Trust Town Office Building 307 Clark Street North Andover , MA 01845 Petition No. 18-' 85 Dear Mr. Long: The Board of Appeals held a public hearing on Monday evening, April 8, 1985 and 'continued to Monday evening, May 13, 1985 upon the application of Miele Realty Trust. The hearing was advertised in the North Andover Citizen on March 21 and 28, 1985 and all abutters were notified by regular mail . The following members were present and voting: Frank Serio, Jr. , Chairman; Alfred E. Frizelle, Esq. , Vice Chairman; Augustine W. Nickerson, Clerk; William J. Sullivan; and Walter F. Soule. The petitioner seeks a variance from the provisions of Section 7, Paragraph 7. 1 and Table 2 of the Zoning By Law so as to permit relief from the minimum lot size requirement on premises located at 307 Clark Street . Counsel for the petitioner testified that the petitioner has entered into a Purchase and Sale Agreement and the variance is needed to allow him to erect a structure to house equipment. The existing sheds and dwelling shown on the plan will be removed. Further testimony revealed that the lot, consisting of 50, 080 square feet, conformed to the area requirement prior to the 1972 rezoning. Upon a motion made by Mr . Frizelle and seconded by Mr . Soule, the Board voted unanimously to grant the variance subject to the condition that the dwelling and garages be razed prior to the issuance of a building permit. 4 Miele Realty Trust 307 Clark Street Petition No. 18-' 85 May 16, 1985 Page 2 In granting the variance, the Board finds that Section 10.4 of the Zoning By Law has been satisfied. In particular , the Board finds that the 1972 action deemed the lot undersized and that desirable relief may be granted without nullifying or substantially derogating from the intent and purpose of the existing Zoning By Law. The Board further finds that a literal enforcement of the pro- visions of the existing By Law would create a financial hardship to the petitioner .
