Minicucci, Special Permit, Watershed District Dear Mr. Lang: After public hearing duly advertised and held on April 7, 1980 and continued, the Planning Beard unanimously voted to approve the Special Permit for Louis Minicucci, Great Pond Rd. subject to the following conditions: Re application for special permit in the watershed district to construct a driveway, plan of land located in North Andover, Ka. for Louis Minicucci dated July 3, 1980 - 1) that as required in the Highway Surveyor's letter dated July 7, 1980: a. existing Catch Basin located on driveway shall be reconstructed as a standard catch basin and existing catch basin located on Great Pond Nd. shall be reconstructed as a standard catch basin as stated in his letter; b. existing 8" drain pipe shall be replaced with a 12" pipe with a minimum of 30" of cover over pipe; o. an open grate cover shall be installed across the driveway aligned with the driveway drain and shall be heavy duty pre-painted steel with bars running parallel with driveway; reinforced rods shall be used in concrete trough; do a permanent earth berm shall be constructed as shown on plan of land located in North Andover, Na. prepared for Louis Nin.icucei and dated July 3, 1980; e. a twenty foot wide repair and maintenance easement shall be conveyed to the Town of North Andover as shown on said plan; f. new plans shall be submitted to the Planning Board which reflect the above changes recommended by the Highway Surveyor; g. 12" pipe to be extended 12 ft, into a stone-tapered and flared headwall to receive all drainage directed to Swale from the hill; and h. trough across the driveway shall be 12" wide. 2) In accordance with the Board of Public Works letter dated May 19, 1980, the driveway shall be constructed to enter the left side of the proposed dwelling as shown on said plan. In accordance with the Board of Public Works letter dated April 17, 1980, all utility lines to be installed shall be installed along the existing driveway. 3) Hay bales shall be placed along the length of the existing and proposed driveway during the entire term of construction activities to prevent erosion. Lyons, Town 01er$ Town Building North Andover, Mass. )ear Sir: The following petition wtis heard at a meeting of the Board of Appeals on Monday evening, March 11 1963 at the Town Office Building. Members present and voting were: Daniel T. O'Leary, Chairman.; Howard Gilman, Henry M. Lund, William Morton and Associate Member Arthur Drumoond who sat in place of regular member Robert J. Burke. Gene A. & Edith R. Minicucci requested a variation of Seo. 6,4, Para. 6.41. of the Zoning By-s,aw so as to permit the sale of a parcel of land 1tr,/00 squame feet in area and to ratify a 1961 subdivision; on the prodses, located at Park Street, the corner of Main Street and Chickering Road. This public hearing was advertised in the Eagle—Tribune on February 25 and March 41 1963. A11 abutters were duly notified by certified mail of this hearing. There were no abutters present and there was no opposition. Atty. Ralph E. Finck represented the petitioner. The Board discussed and voted on the petition. Mr. Gilman made a motion to GRANT the variance, Mr. Lund seconded the notion and the vote was unanimous. This variance is granted for the following reasons: 1, There e3d.st certain conditions, especially affecting the parcel in question, which do not generally affect the entire zoning district in which the parcel is located. 2. The requested variance will not adversely affect the public good, 3. The requested variance will not be in substantial derogation from the intent or purpose of the Zoning'By Law. A meeting was held on Monday, 'November 10, 1958 at 7:30 PM on the application of Louis Minicucci, for a variance from the pro- visions of Section 6, paragraphs 6.2 and 6.41 so as to permit the the erection of a�single residence on the premises on the northerly side of Main Street, 70 feet distant from the corner of Chickering Road. Present and voting were : Daniel T. O'Leary, Chairman, Kenneth Terroux, Secretary, Donald F. Smith, Robert Burke and William Morton, Associate Member designated by the Chairman to sit in place of Henry Lund, regular member who was absent. There was evidence, and the Board so finds, that the premises are In a Village Residence Area, that the petitioner has an option to purchase a triangular parcel of land to the West of and contiguous to his ;premises, as shown on a plan of land entitled "Plan of Land in North Andover, Mass . Surveyed for Louis Minicucci, Sept. 6, 1958s Santo S. II colosi, C.E.?' which plan is annexed hereto and made a part of this decision. The Board further finds that the petitioner's lot has presently a frontage of 82.85 feet on Main Street, that he proposes to acquire the triangular parcel mentioned above so that he will then have a front::-.ge of 101.0 feet. The Board also finds that the present frontagecC the Lot to the West of the premises in question presently has a frontage; of about 82 feet and that if the petitioner is allowed to enlarge his frontage as proposed, the lot to the West will then have a fronage of ap-proximately 64 feet. The Board finds also that the petitioner plans the erection of a home 70 feet in width and that it is necessary that he obtain the triangular parcel mentioned above in order that he may satisfy the side line requirements of a lot in a Village Residence area. On motion duly made and seconded, it was unanimously VOTED: That the application for a Variance be denied. REASONS FOR DECISION: The lot in question as it presently exists is suitable and meets all requirements for the erection of a home of somehwat smaller proportions than that proposed by the petitioner. The Board finds that the petitioner will suffer a hardshiponly in that he will be required to erect a home smaller than he would desire to erect, upon the denial of the relief requested cannot be granted without making still less conforming an already existing lot which Is of less area and frontage than is required by the By-Law and that to grant the relief would be to substantially derogate from the in- tent and purpose of the By-Law.
