Lyons, Town Clerk Town Office Building North, Andover, Mass. Dear Sir: A public hearing was held by the Board of Appeals on September 181 1972 upon application of DANIEL MORENCY who requested a variation of Sections 6.1, 6.21 6.3 and Table 2 of the Zoning By—Law so as to permit the division of land and the formation of a lot that does not meet the area requirements of the Zoning By—Law located at Browns Court and the east side of Garden Street. The following members were present and voting: J. Philip Arsenault, Chairman; Dr. Eugene A. Belivieau, Clerk; Arthur R. Drummond, Frank Serio, Jr. and Associate Member Louis DiFruscio who sat in place of regular member Kenneth Pickard. The hearing was advertised in the Lawrence Eagle—Tribune on September 2 & 9r 1972 and all abutters were duly notified by regular mail. Mr. Morency appeared in his own behalf and explained that he had purchased the property about two months ago and was not aware at that time that a variance was necessary; he was under the impression that he had a buildable lot in addition to the two houses and barn presently there. He said there is a hardship because the price of the land was such that it would be for a buildable lot; he purchased the land with the intention of building a house and living in it. He said there are other lots in the area as small as this and smaller which the Board granted to Davis & Furber Machine Co. He will use Browns Court for access and has no intention of doing anything with Garden Street, of which that particular section is a paper street. He did not have complete plans but would submit them to the Board at a later date. Several abutters were present and one was recorded as objecting. The Board noted that the lot line would be right up against the existing house. The petition was taken under advisement and during this period was reviewed by the Board. Mr. Drummond made a motion to DENY the variance; Dr. Beliveau seconded the motion and the vote was unanimous. The Board found no hardship. Very truly yours, BO OF APPEALS ��-�-�c .
