Clerk. TOWN OF NORTH ANDOVER MASSACHUSETTS BOARD OF APPEALS March 21, 1984 Mr. Daniel Long, Town Clerk William and Margaret Smith ToWn Office Building 182-184 Middlesex Street North Andover, Mass. Petition No. 10- 184 Dear Mr . Long: The Board of Appeals held a publics hearing on Monday evening, March 12, 1984 upon the application of William and Margaret Smith. The hearing was advertised in the North Andover Citizen on February 16 and 23, 1984 and al1' abutters were notified by regular mail`. The following members were present and voting Allred E. Frizelle, Esq. , Vice Chairman; William J. Sullivan; Augustine W. Nickerson; and Associate Members Maurice S. Foulds and Raymond A. Vivenzior Esq. The petitioners seek a Special Permit under Section 4, Paragraph 4.122 of the Zoning By Law so as to permit the conversion of an existing two-family dwelling into a three-family dwelling, on premises lo- cated at 182-184 Middl)ssex' Street, located in the R-4 zoning district. Mr . Smith testified that no exterior changes are proposed. He and his family occupy a unit in the dwelling and he proposes to convert the first floor from one apartment into two apartments. There are currently five off-street parking spaces and a sixth can be provided. No opposition was voiced at the hearing. William and Margaret Smith NOR ,'I J ; IER Petition No. 10-' 84 182-184 Middlesex' Street MAR 2S I A March 21, 1984 Page 2 Upon a motion made by Mr. Foulis and seconded by Mr. Sullivan, the Board voted unanimously to grant the Special, Permit subject to the following conditions: 1. That six` (6) parking spaces be provided on the property and that the six (6) spaces be installed prior to the issuance of a building permit for the conversion. 2. No exterior changes to the dwelling shall' occur . In granting the Special' Permit, the Board finds that the following conditions have been met, pursuant to Section 10.31 of the Zoning By Law: 1. The specific' site is an appropriate location for such a use, since the dwelling is located in the R-4 zoning district where other multi family dwellings exist. 2 . The use as developed will not adversely affect the neighborhood, since the neighborhood consists of single, two, and multi family dwellings. 3. There will' be no nuisance or serious hazard to vehicles or pedestrians, since the conversion represents the addition of one additional' apartment. 4. Adequate and appropriate facilities, including off-street parking, will be provided for the proper operation of the proposed use of the dwelling.
