APPLICANT'S REASONS FOR BELIEVING THAT APPROVAL OF THE PLAN SUBMITTED HEREWITH
IS NOT REQUIRED BY THE SUBDIVISION CONTROL LAW:
The applicant respectfully requests the approval for recording
of the submitted plan, because this is merely a readjusting of lot
lines on a prior approved subdivision boarding on a public way.

N.B. The subdivision control law requires the Planning Board to make the re-
quested determination "unless such plan shows a subdivision.".G.L. C. 41, S. 81 P.
Accordingly, the foregoing statement of "reasons" must clearly indicate that
the subject plan does not "show a subdivision", which is defined by G.L. c.,.41,
s. 81 L (as amended by St. 1963, c. 580), as follows:
"Subdivision" shall mean the division of a tract of land into two or more
lots and shall include resubdivision, and, when appropriate to the context, shall
relate to the process of subdivision or the land or territory subdivided; pro-
vided, however, that the division of a tract of land into two or more lots shall
not be deemed to constitute a subdivision within the meaning of the subdivision
control law if, at the time when it is made, every lot within the tract so divi-
ded has frontage on (a) a public way, or a way which the clerk of the city or
town certifies is maintained and used as a public way, or (b) a way shown on a
plan theretofore approved in accordance with the subdivision control law, or •
(c) a way in existence when the subdivision control law become effective in the
city or town in which the land lies, having, in the opinion of the planning
board, sufficient width, suitable grades and adequate construction to provide
for the needs of vehicular traffic in relation to the proposed use of the land
abutting thereon or served thereby, and for the installation of municipal ser-
vices to serve such land and the buildings erected or to be erected thereon.
Such frontage shall be of at least such distance as .is then required by zoning
or other ordinance or by-law, if any, of said city or town for erection of a
building on such lot, and if no distance is so required, such frontage shall be
of at least twenty feet. Conveyances or other instruments adding to, taking away
from, or changing the size and shape of, lots in such a manner as not to leave
any.-lot so affected without the frontage above set forth, or the division of a
tract of land on which two or more buildings were standing when the subdivision
control law went into effect in the city or town in which the land lies into
separate lots on each of which one of such buildings remains standing, shall not
constitute a subdivision.

Dear Sir:
The following petition was heard at a meeting of the Planning Board on Monday
evening, March 19, 1973 at 7:30 P.M. in the Town Office Building meeting rooms
The following members were present and voting: William Chepulis, Chairman;
John J. Monteiro, Vice Chairman; Paul R. Lamprey, Clerk; Donald N. Keirstead and
Fritz Ostherr,
ANDREW P. SORBO petitioned for a subdivision of a parcel of land, containing 6.4
acres, 9 lots, entitled "Andrew Circle" located on the southwest corner of the
intersection of Andover Street and Cypress Terrace,
Atty. Maurice Schwartz represented the petitioner. He said the subdivision plans
meet all of the requirements and regulations of the torn; all lots have the re-
quired frontage and area and maay are in excess of the requirements. The roadway
has been laid out as required. They contemplate single family homes but zoning
does allow other uses and they will comply with the zoning requirements. Mr. Sorbo
has a purchase and sales agreement with Mr. Melamed and upon approval of the sub-
division, the land will be purchased. Several abutters were present and were eon-
cerned that the area was now zoned for ]2,500 sq. ft. lots. Water and sewer is
available and drainage will be taken care of.
Mr. Keirstead made a motion to APPROVE the subdivision; Mr. Monteiro seconded the
motion and the vote was unanimous.
The conditions are as follows:
1. That the record onagers of the subject land execute and record a "covenant
running with the land" within 20 days from the date of this decision, or otherwise
provide security for the construction of ways and the installation of municipal
services within said subdivision, all as provided by G.L. c. 41, S. 81-U,

2. That all such construction and installations shall in all respects
conform to the governing rules and regulations of this Board.
3. That water and sewer will be according to the rules and regulations of
the Board of Public Works.
4. That surface drains and street bounds must be installed= the roads must
be hot-topped and constructed all in accordance with the requirements under
the Subdivision Rules and Regulations of the Planning Board. Proper street
signs must be installed. Appropriate inspections for the satisfactory
completion of the provisions in this paragraph are to be performed under the
direction of the Office of the Highway Surveyor.
5. Must comply with the Board of Fire Engineers' requirements as to the fire
alarm system.

Requirements as to the coni,cnis of "definitive plans":
G.L. c. 41, §, 81 p, briefly describes a "definitive subdivision plan" as "a
plan of such proposed subdivision, showing the lots into which such land is to
be divided and the ways already existing or which are to be provided... .. for
furnishing access to such lots . .. . ." However, such a pian should also supply
the data required of "preliminary plans" under G.L. c. 41, § 81 L, as follows:
"Preliminary plan" shall mean a pian of a proposed subdivision or resubdivi—
sion of land drawn on tracing paper, or a print thereof, showing (a) the
subdivision name, boundaries, north point, date, scale, legend and title
"Preliminary Plan"; (b) the names of the record owner and the applicant and the
name of the designer, engineer or surveyor; (c) the names of all abutters, as
determined from the most recent local tax list; 1d) the existing and proposed
lines of streets, ways, easements and any public areas within the subdivision
in a general manner; (e) the proposed system of drainage, including adjacent
existing natural waterways, in a general manner; (f) the approximate boundary
lines of proposed lots, with approximate areas and dimensions; (g) the names
approximate location and widths of adjacent. streets; (h)and the topography of
the land in a general manner.
It should also conform to the rules and regulations of the North Andover
Planning Board relative to definitive plans, and to the requirements imposed
by law for the recording of plans at the Registry of Deeds.
