Dear Mr. Long :
The Board of Appeals held a public hearing on Monday evening,
April 12 , 1982 upon the application . of Thomas P . and Patricia
Ventura. The hearing was advertised in the North Andover Citizen
on March 25 and April 1 , 1982 and all abutters were notified by
regular mail . The following members were present and votingt
Frank Serio , Jr . , Chairman; Alfred E . Frizelle , Esq : , Vice-
Chairman ; Augustine W . Nickersont Maurice S . Foulds and Walter
Soule . The Board voted to take the petition under advisement
and rendered their decision on May 10 , 1982, at which time all
voting members except Mr. Foulds 'were present.
The petitioner seeks a variance from the provisions of Section 7 ,
Par. 7. 2 , 7. 3 , and Table 2 of the Zoning By Law and a Special
Permit under Section 4 , Par. 4. 122 ( 14) to permit the conversion
of a two-family dwelling to a four-family dwelling on premises
located on the North side of Ashland Street and known as 22-24
Ashland Street.
Throunh counsel and by testimony , the petitioner introduced
evidence showing that the dwelling had been constructed on the
premises prior to the enactment of the Toning By Law and that
there are multi -family dwellings in the neighborhood. The peti -
tioner proposed that parking be provided on the side of the dwelling .
According to the petitioner , it is economically necessary to convert
the existing two-family unit to a four family unit and the variance
request is necessary because of the dwelling ' s non-_conformance .

At the hearing , the Director of Community Development spoke in
favor of the petition , citing the lack of apartments in the town,
and no one spoke in opposition .
Upon a motion made by Mr . Frizelle and seconded by Mr. Nickerson ,
the Board voted unanimously to grant the variance as requested and
to grant the Special Permit subject to the following condition :
That the parking lot , with a minimum of eight (8) spaces , be con-
structed to the rear of the building , and that the builidng ( shed)
as shown on the plan be removed prior to the issuance of a building
permit for renovations .
The Board finds that the particular location is suitable for a
four-family unit and that each of the provisions of Section 10 ,
Par . 10. 31 for a Special Permit have been satisfied . Further,
the Board finds that the provisions of Section 10 Par. 10 .4 have
been satisfied in regard to granting the variance.

Vote to disapprove the Ventura Preliminary Subdivision Plan for
incomplete subdivision submittal and for the following reasons:
1. The length of the dead-end road exceeds the maximum length
allowed in the Board' s Subdivision Rules & Regulations and
no waiver request or supportive criteria have been
submitted for consideration.
2. The North Andover Conservation Commission has informed the
Planning Board that an accurate representation of wetlands
are not shown on the plans that exist in the field. A
stream exists along lots 4, 5 and 6 and Bordering Vegetated
Wetlands are not depicted.
3. The easement shown for roadway access from Bridges Land is
not acceptable. The ownership is unknown and right of
passage is not documented.
4. Inaccurate references to the Bridges Subdivision are shown
on the plan.
5. Adjoining properties are not shown to ascertain future
access and connection to abutting properties.
6. No test pit percolation data or spring water table
information is provided to determine the feasibility of the
subdivision in accordance with the Board of Health's
recommendations.
7. In accordance with Section III, A, 21 11 Major Site
Features are not shown on plan.
8. The plans are not stamped by a Registered Professional
Engineer.
9. The following has been omitted:
- drainage system
- profiles
- utility plans
- proposed easements
- corner roundings on Bridges Lane
- topography on Lots 5 and 6
- flood plain areas in accordance with/FEMA maps.
10. In accordance with other town department recommendations
and concerns.
