Lyons, Town Clerk Town Building North Andover, Mass. Dear Sir: The following petition wan heard at a meeting of the Planning Board on Monday evening, December Q, 1961 at the Town Office Building. The decision was made on January S. 1962. Members present and voting wares James M. Bannan, Chairman; Robert J. Burke, Secretary; Howard L. Gilman, George Farley and William Chepulis, Jr. Charles Waites petitioned to amend the Zoning Map and the Zoning by-law of North Andover to change from a Village Residential District to a General Business District, a parcel of land on Saunders Street. Atty. John J. Willis represented the petitioner, and explained the need of re-zoning, in order to rebuild the Hunt Club, owned by the petitioner, vhich was partially destroyed by fire in 1961 and later razed. There were approxi- mately 44 people present at the hearing. Six abutters were recorded as opposed and three spoke in favor. At the Planning Board meeting on January S, 19621, the board voted on the petition. Mr. Burke made a motion to deny the petition, Mr. Chepulis seconded the motion and the vote was unanimous. It is the opinion of the board that the area is not suitable for busi- ness purposes. The area did not comply with the lot size requirements of a General Business District. Dear SirR This case came on to be heard at a meeting of the Beard of Appeals oat Wednesday, September 27, 1961. Members present sad voting"weres Daniel T. O'Leary, Chairman, Henry Lead, ward Gilman, Robert Burke and Har*3A Morley Jr. Charles Waites requested a variation of Section 4 Paragraph 4.06 of the soning By Lav so as to permit the construction of a private clubkouse on the premises located at 80 Saumdors Street. Attorney Alfred Daniels appeared for the petitioner and stated the potitioner was at the moray of the Board as the building was of a non-conforming use. He said he felt a variance should be granted as this is a hardship case in that it is the sole moans of support for the petitioner's family. He also said the petitioner ran an orderly business and that this type of club was in the area for soupy years. Neighbors opposing the variance worse Mr.-& Mrs. Stanley Hurrell, William Harrell, Mr. do Mrs. Donald Haigh, Mrs. Ezra Rautbier, Mary Sheridan, Katherine Sheridan, Mr. & Mrs. William Farrell, Mr. & Mrs. John Lyons, Mrs. Tvonne Whittaker, Katherine CumLingbom and Mrs. Jeba Costello. The opposition stated the olub produces a traffic problem in the area and causes a great deal of noise. Upon motion duly made sad seconded it was-voted 3-2 that the variance do denied. The reason for the denial is that ilk is felt the sprit of the sowing lar is, with in mind to eliviate noa-conforming roses as the plWaical characteristics of the name dis- appear and since the building disappeared, the area should resesrt back to a village neighborhood district as not forth in the By Lay. Dear Sirs The following petition was heard at a meeting of the Board of Appeals on Monday evening, March 12, 1962 at the Town Office Building. Members present and voting were: Daniel T. O'Leary, Chairman; Harold Morley, Secretary; Robert J. Burke, Howard Gilman and William Mortoh, Associate Member who sat in place of regular member Henry E. Lund. Charles Waites requested a variation of Sec. 6, para. 6.31 of the Zoning By- Law so as to permit the use of two lots of land mutually adjoining and in one ownership to be used separately for two homes, with each lot containing 8300 sq. feet more or less on the premises, located at the east side of Saunders Street, 100 feet distant from the corner of Cleveland Street and known as 70 Saunders Street. This public hearing was advertised in the Eagle Tribune on February 19, and March 25, 1962. All abutters were duly notified by certified mail of this hearing. Atty. 4ohn J. Willis represented Charles Waites, who was also present. There were no abutters present and there was no opposition to the petition. The Board discussed and voted on the petition. Mr. Burke made a motion to GRANT the variance. Mr. Gilman seconded the motion and the vote was unanimous. The Board granted the variance for the following reasons: 1. There exist certain conditions, especially affecting the parcel in question., which do not generally affect the entire zoning district in which the parcel is located. 2. Unless the variance is granted, the applicant will suffer substantial hard- ship, financial or otherwise. 3. Dear Sirs The following petition was heard at a meeting of the Board of Appeals on Monday evening, October 15, 1962. Due to the presence of more than forty people, the hearing was held at the Fire Station meeting room. Members present and voting were: Daniel T. O'Leary, Chairman; Robert J. Burke, Secretary; Henry S. Lund, William Morton and Associate Member Arthur Drummond who sat in place of Howard Gilman. Catherine D. Lynch, William F. McConnor & Charles Waites requested a variation of Sec. 4, Fara. 4.44 of the Zoning By-Law so as to permit a restaurant. It will also be necessary for a small addition as shown on plan, resulting in rear lot line variance to 18 feet and a side line variance to 18 feet, on the premises, located at south side of Sutton Street, 1000 feet distant from the corner of Sutton St. and Main St. and known as number 213-215 Sutton Street. This public hearing was advertised in the Eagle Tribune on October 1 & 8, 1962. All abutters were duly notified by certified mail of this hearing. Atty. John J. Willis represented Mr. Waites. Mr. McColnaor and Mr. Waites were recorded in favor. Thirty-five people were recorded as opposed. The principal reasons for opposition were the serious traffic hazard on Sutton Street, the large number of children living in the neighborhood, lack of parking space, not the proper place for a liquor establishment, etc. The Board discussed and voted on the petition. Mr. Morton made a motion to DSNY the variance because it does not meet the requirements of the Zoning By-Law under Section 7.4. Mr. Lund seconded the motion and the vote was unanimous. This variance was denied for the following reasons 1. The applicant will suffer no hardship if the variance is denied. 2. : It does not meet the requirements of the Zoning Bylaw under Section 7.4. 3.
