Lyons, Town Clerk Town Office Building North Andover, Ma. Dear Sir: A public hearing was held by the Board of Appeals on March 14, 1977 upon application of Alfred B. Wallack who requested a variation of Sec. 6.3 and Table 2 of the Zoning By—Law so as to permit the construction of a room and garage on a plan of land dated January 24, 1977 located at 127 Beverly St. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Vioe—Chairman; Louis DiFruscio, Clerk; James D. Noble, Jr.; and Assoc. Member, Daniel J. Leonard, Esq. The hearing was advertised in the Lawrence Eagle—Tribune on February 26 and March 5, 1977 and all abutters were duly notified by regular mail. On a motion by Mr. DiFruscio seconded by James Noble, Jr. the Board voted to GRANT a variance of Section 6.3 and Table 2 of the By—Law. The unique composition of the land, where it drops to the rear of the present build— ing, prevents the petitioner from constructing the proposed addition on the Middlesex St. side of his property which would be the most likely place since it gives him the available land. The petitioner requests the variance to allow him to construct an addition to his home for a bedroom for his son who is a paraplegic. Further, he needs a garage which is over—size to place a wheel—chair ramp. In light of these facts, the Board voted to grant the variance and determined that the provisions of Section 9.5 of the By—Law have been met.
