Dear Mr. Long: A public hearing was held by the Board of Appeals on June 9, 1980 upon application of Joseph F., Jr. and Gloria Walsh who requested a variation of Sec. 7.3 and Table 2 of the Zoning By-Law so as to permit the construction of an addition to the dwelling located on 56 Glenwood Street and shown on a plan of land dated May 19, 1980. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice-Chairman; James D. Noble, Jr., Clerk; Richard J. Trepamier, Esq.; and William J. Sullivan. The hearing was advertised in the N. A. Citizen on May 22 & 29, 1980 and all: abatters, - were duly notified by regular mail. The petitioner introduced evidence to the Board showing that the lot in question is smaller than the required lots in the Zoning District. The existing dwelling presently has an attached porch which will be removed to allow construction of the addition. The addition is to allow for added living quarters for the petitioner's family. The size of the lot prohibits the petitioner from constructing the addition in any other place on the lot. The Board, on motion made by Frizelle and seconded by Noble, voted unanimously to GRANT the variance as requested. The Board finds that the provisions of Sec. 10.4 of the BY-Law have been satisfied, particularly, that the size of the lot and the structure thereon prevent the ccastrue- tion of the addition without seeking relief from the Board. Further, the abutting lot, which is open, will allow for open space. The relief can be granted without nullifying WALSH DECISIM -2- nor derogating from the intent and purpose of the By-Lair since there are other dwellings scattered throughout the District with similar setbacks. The present relief will not be a detriment to the public good since it enables adequate open space and allows the petitioner to improve his property.
