CAMPION HALL WGISION - Preliminary Plan June 22, 1977
1. In the presentation, the applicant stated that he chose to retain the present
driveway rather than put in a road to subdivision standards - this is not feasible
because the driveway would be insufficient with a development of this size;
2. Shifting the proposed entrance of the driveway from its present location would
present a hazardous condition on Great Pond Rd. - cumres, poor visibility;
3. The drainage system is questionable;
4. The road profile shows Road B ending up in a 5% grade but where it comes down
frcsm the grounds proper it appears, by scale, to be more steep than the maximum
of 6%;
5. The proximity of the subdivision to Lake Coohiohewiok with its attached drainage
and seepage problems would be detrimental to the health, safety, and welfare of the
citizens of the Town;
6. Because the nature and character of the development are such there would be an
adverse effect on the water quality of the Lake, the Town's drinking water supply;
7. The proposal varies too greatly from Planning Board Rules and Regulations;
8. The subdivision would open up more development in the vicinity of Lake Coohichewick,

At Meeting of July 18, 1977 the Borth Andover Planning Board unanimously voted no
endorsement subject plan for the following reasons:
1) the Plan of Land in Borth Andover, Mae owned by the Society of Jesus of New
Eagland dated July 8, 1977 shows a subdivision;
2) under the subdivision control law the purpose is not satisfactory to the safety,
convenience, and welfare of the inhabitants of the Town;

Dear Mr. Salemme:
On the basis of the proposed plans submitted for the
above-mentioned subdivision and the soil data compiled and the consid-
erations hereinafter mentioned, this Board of Health recommends disapproval
of this subdivision. I
The Board finds from existing data that this development
will have a detrimental effect on the water quality of Dake Cochichewick
and the irpact of its contamination should be minimized. Prom the view-
point of iraste:•,a.ter contamination, it is recommended that the impact can
best be minirrized by the installation of a sewerage system wnich would
collect all the i.-astevrater into a vrastewater treatment plant capable of
secondary treatment. Secondary treatment is defined as a form of treat=
ment which removes 85% suspended solids and 85% biochemical oxygen demand.
"lith this type of treatment plant the wastewater effluent would receive a
small dosage of chlorine to increase microbial kill in the effluent. This j
entire system would substantially reduce the deleterious impact of the i
subdivision on the water quality of the lake.
The three specific findings that lead the Board of
Health to adopt this recommendation is as follows:
1. The existing soil conditions;
2. The steep slope of the terrain and presence of
intermittent streams resulting in flovra.ge towards
the lake; and
3. The present failure of the subsurface disposal
system now servicing existing Campion Hall.
The soil conditions which were corpiled by a representative
of this Board indicate the soil to contain significant quantities of fine
*.• ich
materials, namely clay and silt with some sand and gravel. The phenomena rh
occurs vrhen clay and silt get fret, is that these particles expand and fill
the voidsresent in the soil and the leaching field fails to function

properly. The leachate TOAch normally filters dovnvrard begins to rise to
The surface and then proceeds to flow overland according .to the slope of
the terrain. Since clay and silt are present in significant quantities
(see percolation tests and test pit results), there is a strong likelihood
of failure in the individual systems vhich will lead to contamination of
the lake. This is particularly true in this case because of the proximity
of the s;rstems to the lake.

Anotherecific finding is the steepness of the slopes and

the presence of intermittent streams. These two factors *.:.Tould allow
leachate from any failing subsurface disposal system to flow directly
into the lake during times of surface runoff.
At the present time the subsurface disposal system for the
existing str-acture, Campion Hall,has failed and has been cited by this f
Board. This system, during surface runoff, flows directly into an
intermittent stream iihich is a tributory to the lake. The result is
contardnation by the vaste,:ater from the failing system. Such a result
is indicative of zahat T•nll happen if individual systems fail.

Definitive Plan of Hardtcourt Estates by Frank C. Gelinas & Assoc. dated Jan. 10,
1979 being land bounded as follows: On the North and East by land NIF of Warlick,
on the South and West by Lake Cochichewick.
CONDITIONS OF APPROVAL:
1. That the record owners of the subject land forthwith execute and record a
"covenant running with the land", or otherwise provide security for the construction
of ways and the installation of municipal services within said subdivision, all as
provided by G.L. c. 410 s. 81—U; j
2. That all such construction and installations shall in all respects conform to 1
the governing rules and regulations of this Board;
3. That no work shall be done in the subdivision until security in the form of a
bond or covenant has been duly recorded and the plans are signed and recorded;
4. That any changes made to the definitive plan by other town agencies or officials
shall be submitted to the Planning Board;
5. That individual septic system permits must be obtained prior to the issuance of
a building permit from the Board of Health under the rules and regulations of "Title
V" of the State Sanitary Code;
6. That the developer shall, prior to the sale of individual lots to individual
owners, submit to the Board of Health percolation tests showing the suitability of
said lots for the installation of subsurface disposal systems for single family
dwellings; however, such restriction shall not prevent the mortgage of said lots or
the sale to developers or home builders against whom this condition shall also remain
applicable and enforceable until complied with;
7. That a Notice of Intent shall be submitted by the applicant to the Conservation
Commission in accordance with the Wetlands Protection Act, Ch. 131 of the M.G.L.;
8. That the hydrants (5) shall be located in accordance with the Fire Dept. letter
dated Feb. 12, 1979 and as marked on said plan by the Board of Fire Engineers, and that
the Fire Alarm be brought in from Great Pond Rd. and Pond St. to the development, and
one (1 ) Street Box on Bonny Lane near Lot ;"1 as per Fire Dept. instructions;
9. That all water improvements shall be in accordance with the recommendations of
the Board of Public Works letter dated Feb. 22, 1979 including the additional
CAMPION HALL DECISION - Preliminary Plan June 22, 1977
1. In the presentation, the applicant stated that he chose to retain the present
driveway rather than put in a road to subdivision standards--this is not feasible
because the driveway would be insufficient with a development of this size;
2. Shifting the proposed entrance of the driveway from its present location would
present a hazardous, condition on Great Pond Rd. - curves, poor visibility;
3. The drainage system is questionable;

4. The road profile shows Road H ending up in a 5% grade but where it comes down
from the grounds proper it appears, by scale, to be more steep than the maximum
of 6%;
5. The proximity of the subdivision to Lake Cochichewick with its attached drainage
and seepage problems would be detrimental to the health, safety, and welfare of the
citizens of the Town; -
6. Because the nature and character of the development are such there would be an
adverse effect on the water quality of the Lake, the Town`s drinking water supply;
7. The proposal varies too greatly from Planning Board Rules and Regulations;
8. The subdivision would open up more development in the vicinity of Lake Cochichewick.

tests and test pits on a parcel of land known as Hardtcourt
Estates located in North Andover. The results of my findings

Reference: Application dated Jan. 10, 1979, received by Town Clerk Jan. 12, 1979
Definitive Plan of 11ardtcourt Estates by Frank C. Gelinas & Assoc. dated Jan. 10,
1979 being land bounded as follows: On the North and East by land N/P of Warlick,
on the South and West by Lake Cochichewick.
CONDITIONS OF APPROVAL:
1. That the record owners of the subject land forthwith execute and record a
"covenant running with the land", or otherwise provide security for the construction
of ways and the installation of municipal services within said subdivision, all as
provided by G.L. c. ¢1, s. 81-0;
2. That all such construction and installations shall in all respects conform to
the governing rules and regulations of this Board;
3. That no work shall be done in the subdivision until security in the form of a
bond or covenant has been duly recorded and the plans are signed and recorded;
4. That any changes made to the definitive plan by other town agencies or officials
shall be submitted to the Planning Board;
5. That individual septic system permits must be obtained prior to the issuance of
a building permit from the Board of Health under the rules and regulations of "Title
V" of the State Sanitary Code;
5. That the developer shall, prior to the sale of individual lots to individual
owners, submit to the Board of Health percolation tests showing the suitability of
said lots for the installation of subsurface disposal systems for single family
dwellings; however, such restriction shall not prevent the mortgage of said lots or
the sale to developers or home builders against whom this condition shall also remain
applicable and enforceable until complied with;
7. That a Notice of Intent shall be submitted by the applicant to the Conservation
Commission in accordance with the Wetlands Protection Act, Ch. 131 of the M.G.L.;
8. That the hydrants (5) shall be located in accordance with the Fire Dept. letter
dated Feb. 121 1979 and as marked on said plan by the Board of Fire Engineers, and that
the Fire Alarm be brought in from Great Pond Rd. and Pond St, to the development, and
one (1 ) Street 'Boa on Bonny Lane near Lot #1 as per Fire Dept. instructions;
9. That all water improvements shall be in accordance with the recommendations of
the Board of Public Works letter dated Feb. 22, 1979 including the additional

shown on the plan;
c) Manholes shown in front of Lots 7 9 to be changed to catch basins and to be

d) All parallel underground telephon and electric lines to be put on the westerly
side of the road;
e) Shoulders on northerly or uphill ide of Bonny Lane to be swaled and subdrains
installed where necessary, to be etermined in the field. Slopes in shoulders

3. This action is brought under the provisions of G.L. c. 41 ,
section 81 BB and G.L.c. 231A,
4. On January 12, 1979, the plaintiff filed with the Town Clerk
and an agent of the Town of North Andover in the manner
traditionally followed by the Town , directed to the defendant
and the Town of North Andover Board of Health requesting
the approval of a proposed subdivision plan entitled "Definiti e
Plan of Hardtcourt Estates".
5. Said plan evolved from a preliminary plan submitted to the
defendant on June 26, 1978 and approved on October 23, 1978.
6. On or about March 8. 1979, the defendant disapprovedthe said
plan, basing its decision on a letter received by the defen-
dant from the North Andover Board of Health dated March 51
1979. Said decision is attached hereto as Exhibit A. tt
7. The letter of the Board of Health upon which the defendant
based its disapproval was received by the defendant more
than 45 days after the plan was submitted to the Board of
Health.
8. Failure of the Board of Health to report to the 'defendant in
writing , approval or disaoproval of the said plan within 45
days of submission is to be deemed approval by the defendant
under the provisions of G.L.c. 41 , section 81U.
