County Commissioners May 14, A.D, 1977 The Board of Seleectmen of the Town of North Andover in the County of Essex, Massachusetts,. by their petition to said Commissioners, represent that the lines of the highway known as Waverly Road, from the Andover town Lime to gain Streaet, as established by the County Commissioners in October of 1656, are vague, indistinct and difficult to ascertain, and that common convenience and necessity require that the location of the said 1896 street lines be redetermined and relocated and they pray that after due notice and a hearing, the County Commissioners may relocate and redetermine the location of the existing street lines of said highway, all as in their judgment may be neeoessary. This petition was entered 4aaa.;March 9r 1977 and ,notice was ordered given to all persons and corporations interested therein of the time and place when and where the Commissioners would meet for the purpose of viewing the ,premises and Beaking such order in relation to the gayer of said petit on as by law they may be authorized to do, as by their order of notice on fila and of record will more fully appear. And on April 19, 1971 the County Cosimissioners did adjudge that common convenience and necessity require the relocation of said highway from the AMover town line to about 200 feet north of Williams Street, and thence the said petition has boon continued to this time. And now, the said Commissioners make return of their proceedings in the matter as follows: At the time of the hearing upon the petition for relocating said highway, no person interested having ob jeecte C we, the County Commissioner* for said County, did proceed to relocate said highway as prayed for in said petition from the Andover town line to about 200 feet north of Williams Street. And the following is a true description of the highway as hereby relocated, STVRLY LINE - Beginning at the town corner monument known as Lawztence - North Andover - Andover, boasted on the westerly side of Waverly Road and thence running N, 120 54' 02" S. mine hundred sixty two and seven one--hundredths (962.07) feet to a point on the Southwesterly side of Salem Turnpike, a State highway; beginning again at a point on the Northeasterly side of Salem Turnpike,, said point bearing H. 12' S61 42" E. eighty four and seventy-eight oise-�huadredths (94.76) feet from the terminus of the last mentioned course and thence running N. 120 $61 020 E. seventy and fourteen one-hundredths (70.14) fe r thence curving to the left and running ono thousand four hundred sixty five and fifty-two one-hundredths (1465.92) .feat on am are of a circle having- a radius of two thousand eigr2t hundred eighteen 1 r .2- and- thirty-six "2..and thirty►-six onc-hundredths (3818.36) feast; thence N. 16' 51' 34" W* six hundred ninety* eight and sixty-two one hundredths (698.62) feet; thence curving to the right and running eight hundred twenty mine and nineaty- our ono-hundredths (839.94) felt on an arca of a circle having a radius of three thousand six hundred thirty two and twetty-five one-hundredths (3633.39) feet; thence E. 030 46• 04" W. two thousand four hundred tour and twouty- onee one-hundredths (2404.31) feet to a point on the southwesterly side of Massachusetts Avenue, x Btate highway; beginning again at a paint on the Northeasterly side of Massachusetts Avenue, said paint bearing N. 03. 46' 04" W. eighty tvo and twenty- two one-hundredths (82.22) feet from the terminus of the last mentioned course, and running N.030 46' 040 W. *ovon hundred eighty* two and five one-hundredthe (782.05) foot the above described line to be the westerly line of the highway as hereby relocated. EASTERLY LINE - Beginning at a point can the >sastorly side of Waverly Roatd, said point supposed to be on the lime between the town of Andover and the town of earth Andover. beating 8. 610 05' 08" E. sixty eight and sixty-six one-hundrrodths (68.66) feet from the point of beginning of the above described westerly line and thence running N. 120 56* 02" E. nine hundred twenty seven and seventy-six one-hundredths (927.76) toot to a point on the southwesterly side of Sale % Turnpike, a state highway; beginning again at a point on the northeasterly side of sales Turtapike, said point tearing H. 120 56' 02" B. eighty four and seventy-eight one-hundredths (84.78) feat from the terminus of the laalst mentioned courses thence running N. 124 S6' 02" s. one hundred twenty three and thirty-tures arae:-bundrodths (123.35) feet; thence curving to the left and running Gine thousand four hundred ninety nine and eighty-four one-hundredths (1499.84) feet are an arc of a circle having a radius of two thousand eight hundred eighty-four and thirty-six one-hundredths (2884.36) tereet3 thencee N. 160 51' 34" W. six hundred ninety eight and sixty-two one-hundredths (698.62) feet; tlhonce curving to the right and running eight hundred fourteen and eighty six one-hundredths (814.86) feet on an arcs of a circle having a radius of three thousand five hundred sixty six and twenty five one-hundredths (3566.25) fsatx thencea N. 030 46' 04" T4, two thousand three hundred fifty five and nineteen one-hundredths (2355,15) freest to a paint on the southwesterly sine of Massachusetts Avonue, a State highway, beeginninc again at a point bearing N. 03. 415' 04" W. eighty two and twenty-two ono-hundredths (82.22) feet from the terminus Of the Last mentioned course and running N. 030 46' 04® N. eight hundred thirty one and seven one-hun4reedths (831.07) toot; the above described line to be the easterly line of the highway as hereby r4lecated, .3V Laying all the lands between the above described westerly and easterly lune into the highway, so that the same shall be as shown can a plan filed herewith and deposited in the office of the County Sngina*or, bearing the RECORD NUMBER 3152, which plan is Stade a part of this decree and reference may be had to it for a more particular description. And all portions of the existing highway lying outside the limes as heroin established and: between the termini above mentioneds exempt such portions of the existing highway as connect with other existing ways are thereby discontinued, And we have caused permanent stone monuments, each bearing on its top the letters R.C. , to be seat at the angle points, points of curvature, points of tangency and termini of the above deescribesd lines, the required point in each cases being marked by a braves pian in lead in a drill hole in the center of the top of the monument. It is the belief of the said Commissioners that the lines of the highway as hereby relocated follow as closely as can be determined the lines established by the County Commissioners in October of 1856 and that no ascertainable additional areas are taken by this decree, and, therefore, no damages are awarded. However, should any damages be awaa:deel, they shall be paid out of the treasury of thee town: of North Andover, and should the county be put to any legal expense,, or any other expense relating to damages e or any further damages be recovered,, theysbal:l be paid out of the treasury of said town. ,And the petition is lett open for further aactian. And, said road shall, be known as a public highway forever. And the said Comissioners Border that this return be rocorded, and that all the matters therein ordered be done and performed accordingly.
