Town Office Building 815 Turnpike Street North Andover, Mass. 01845 Petition No. 26- 184 Dear Mr. Long: The Board of Appeals held a public hearing on Monday evening, May 21 , 1084 upon the applica i n f he Willows, Inc. The hearing was advertised in the North Andover Citizen on April 26 and May 3, 1984 and all abutters were notified by regular mail. The following members were present ana voting: Frank Serio, Jr. , Chairman;, Richard J. Trepanier , Esq. , Clerk; William J. Sullivan; Augustine4. Nickerson; and Associate Member Raymond A. Vivenzio, Esq. The pettioner seeks a Special Permit under Section 4, Paragraph 4. 129 of the Zoning By Law so as to permit the construction of a heliport on premises located at the corner of Turnpike Street and Willow Street , known as 815 Turnpike Street (Route 114) , located in the In4ustrial-1 (I-1) zoning district. Mr. Robert Regan testified that the proposed heliport would be located on the roof of the new addition to the racquetball club, located in the Willows Professional/Industrial Park. It will be twenty-four (24) feet off the ground. It will be approximately eight hundred (800) feet from Turnpike Street (Route 114) , a State highway. The heliport will be for his personal use and for use by tenants of the professional and industrial parks. No fuel will be stored on the site. The proposed flight pattern will not be over the adjacent residential area. Upon a motion made by Mr. Nickerson and seconded by Mr. Vivenzio, the Board voted unanimously to deny the petition. In denying the Special Permit , the Board finds that Section 10.31 of the Zoning By Law has not been satisfied. In particular, the Board finds: 1. The specific site is not an appropriate location for such a use or structure, given its close proximity to a neighboring residential district , a restaurant, a gas station, a tennis club., an industrial park which has not reached its building potential , a proposed industrial park to be constructed in the near future, an office park, and the State highway. 2. The use as developed will adversely affect the residential character of the abutting R-2 district . 3. The request represents a potential safety hazard to vehicles and tenants of the professional and industrial parks as well as the surrounding businesses and homes . 4 . The proposed use and the proposed site are not in harmony with the general purpose and intent of the Zoning By Law, since an airport with helicopter landing pads is available and convenient to the petitioner at the nearby Lawrence Municipal Airport, located in North Andover, Mass. Lyons, Town Clerk a /A IU Town Office Building 0 North Andover, Na. 5" Dear Sir: A public hearing was held by the Board of Appeals on July 11, 1977 upon application of The Willows, Inc., d/b/a Willows Racquet Club, requesting a Special Permit under . Sec.4.129(9) of the Zoning By-Law so as to permit the addition of an outdoor swim- ming pool with pertinent amenities with option to add two additional tennis courts and outdoor shelter as shown on a plan of land dated June 14, 1977 located on Turn- pike St. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Vice-Chairman; Ralph R. Joyce, and Sandra Munroe. The hearing was advertised in the Lawrence Eagle-Tribune on June 25 & July 21 1977 and all abutters were duly notified by regular mail. Robert Regan appeared on behalf of the Willows, Inc. and introduced plans showing the proposed use 6f two additional tennis courts and a swimming pool to the presently existing facilities as shown on a plan dated Sept. 10, 1973. No one appeared in opposition to this expanded use. The Board continued the public hearing to the next regularly scheduled meeting which was held on August 81 1977 and instructed Xr. Rom to provide specific locations, dimensions, etc. on the 2 courts and swimming pool and to direct his attention to the matter of parking for the entire facility. On August 8, 1977 Mr. Regan reappeared submitting an updated plan dated June 14, 19r showing the 'precise location of the pool, courts and parking facilities. This plan dated June 14, 1977 is hereby incorporated by reference and made a part of this deci- sion. The Board, in its determination, considered the fact that the use had already by recreational and, therefore, is an appropriate location for the use which is pro- posed in the special permit. Further, considering the nature of the area as a recrea- tional facility it did not adversely affect the neighborhood or create a nuisance or hazard to vehicles or pedestrians. DECISION —2— parking and restaurant facilities presently on the site were adequate for the expanded ' use as dictated by the North Andover Zoning By—Law. The Board unanimously voted to GRANT the permit on the motion made by Ralph R. Joyce and second by ;Alfred E. Frizelle with the following conditions which are incorporated into the Special Permit: 1 A 10 ft. chain link fence with a dark green wind screen is to be provided; 2 The banking in the front of the property is to be graded, loaned and seeded; j The additional parking facilities will be allowed provided the area is hot topped and marked as required under the Zoning By—Law; 4) Plan reference dated June 14, 1977; 5) The petitioner, in accepting the benefits of this Special Permit, agrees to waive any property rights inconsistent between the two permits. Lyons, Town Clerk Town Office Building North Andover, Mass. Dear Sirs A public hearing was 'held by the Board of Appeals on August 139 1973 upon application of The Willows, Inc., Who requested a special permit under Section 4.129 (9) of the Zoning By-Law so as to permit the addition of four outdoor tennis courts to the existing tennis club, with the option to add either one additional tennis court or two platform tennis courts. Also, a request to waive condition #2 of the special permit to be allowed to remove only those trees necessary for the construction of the courts; located at the west side of Turnpike Street; approx. 900 feet from the corner of Willow Street and known as 815 Turnpike Street. The following members were present and voting: Frank $erio, Jr., Chairman; Dr. Eugene Beliveau, Clerk; William N. Salemme, Louis DiFruseio and Associate Member Alfred E. Frizelle, Esq., who sat in place of regular member Arthur R. Drummond. The hearing was advertised in the Lawrence Eagle-Tribune on July 28 and August 41, 1973; and all abutters were duly notified by regular mail. Robert Regan represented the petitioner and explained that they want to expand the tennis courts to make it a year-round facility. They want to add four outdoor courts and possibly two platform tennis courts. They also want to waive condition #2 of the Boardts decision dated July 8, 1971 which states that the existing trees as shown on the plan are to be left as they are for screening. This waiver would be necessary in order to construct the additional courts. They would only remove the trees that are necessary and would try to keep as many trees as possible. No one else 'spoke and there was no opposition. The petition was taken under advise- ment and the Board will view the area. At a meeting held on September 10, 1973, the Board further discussed the petition. Dr. Beliveau made a motion to GRANT the special permit subject to the conditions of grading, loaming and seeding the banks in the front and providing a 10 foot chain link fence with a dark green wind screen. Also, to waive condition #2 of the Board's decision dated July 8, 1971, so that only the necessary trees will be removed to allow the construction of the four additional outdoor tennis courts and the future addition or either one additional tennis court or two platform tennis courts, all as shown The Willows' Inc. —2— September 140 1973 , on the submitted plan. Mr. Salemme seconded the motion and the vote was unanimous. The additional parking facilities will be allowed provided the area is hot—topped and Tarked as required ?ander the Zoning By—Law. , These additional tennis courts would not have any adverse effect to the area; also, this would be in keeping with the recreational facility as 'allowed under the original special permit. Access is provided to the site by a 150 foot right-of-way to Rt. 125. The access area is in the town of Andover. (See attached fig 1 ) . The parcel is an area that is zoned industrial. The land is wooded and has a small area of wetlands on it. Access to the land requires a curb cut from It 125. We have recently filed for a curb cut permit with the Massachusetts Department of Public Works and as a -result have been asked to file this Environmental Notification Forts (ENF) . The construction of the access will enable the land to be developed as an industrial site. The extent and nature of the industrial development is unknown at this timet however, it could take two forms- either an industrial park consisting of 10 two to three acre sites or be developed as a site for a single Industry.
