Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening, January 9, 1967 at the Town Office Building and later adjourned to the Fire Station Meeting Room due to a large number of people being present for an earlier hearing. Members present and voting wares William G'hepulis. Chairman; Robert J. Burke, Vice Chairman; Howard Gilman, Secretary; James M. Bannan and George B. Farley. DOUGLAS E. WILSON at ux petitioned to subdivide a parcel of land on a portion of Lisa Lane consisting of Lots 1, 2, 3 and /+, in accordance with the plans submitted. Atty. Philip Arsenault represented the petitioner in place of Atty. Donald F. Smith who could not represent his client due to illness. Mr. and Mrs. Wilson were also present. Mr. Arsenault explained the plans to the Board and those present. The area involved is at the end of Lisa Lane on an incline and a curve. Mr. Wilson plans to build his own home on one lot. A letter was read from the Board of Public Works informing him that he cannot connect to the Town water system because the land is too high and there would not be enough pressure. Two abutters looked at the plans and asked questions of the peti- tioner. There was no opposition. Mr. Burke made a motion to take the petition under advisement. Mr. Gilman seconded the motion and the vote was unanimous. At a special meeting held on January 23, 1967, the Board discussed and voted on the petition. Mr. Burke made a motion to approve the subdivision plans, subject to the following conditions. Mr. Bannan seconded the motion and the vote was unanimous. Conditions 1. That the record owners of the subject land forthwith execute and record a "'covenant running with the land*-, or otherwise provide security for the construction of ways and the installation of municipal services within said subdivision, all as provided by G.L. c. 41, p. 81—U. t -2- January 23, 1967 2. That all such construction and installations shall in all respects conform :bo the governing rules and regulations of this Board. 3. That, as required by the North Andover Board of Health in its report to this Board, no building or other structure shall be built or placed upon lots as shown ' on said Plan without the prior consent of said Board. of Health. 4. That water and sewer will be according to the rules and regulations of the Board of Public Works, if applicable. 5. That surface drains and street bounds must be installed; the construction of streets and driveways shall be subject to the approval of the Highway Department. 6. The roads mast be hot-topped and proper street signs installed. 7. Approval is subject to the requirements of the Local and/or State Dept. of Public Health regarding sanitary disposal systems. 8. lxhist comply with the Board of Fire Rngineerst requirements as to the fire alarm system, if applicable. C. 41, § Q) 0, briefly describes a "definitive subdivision plan" as "a plan of such proposed subdivision, showing the lots into which such Iand is to be divided and the ways already existing or which are to be provided. . ... for furnishing access to such lots . .. . ." This public hearing was advertised in the Lawrence Eagle-Tribune on Febreary 16 & 239 1974. All abutters were duly notified by certified mail.
