The meeting was called to ~rder by the Chairman a~. 7:30 p.M, in the Tewn-

G~ Be Howe ~e construot a motel on Chickering Reade The Public Hearing
In this application was held on Sept~nber 14~ 1953,
Members present: ~lchard G, ~hipple, Chatrman~ Andrew E. Alvl_noz $~etary~
Henry E, land, Peter..Rltchle~ and associate member Benedict Perrono,
Nicholas Nieetta~ newly appointed member was also present but asked to be
excused from the ~te as he had net been present at the Publ/c Hearing and
had not h~ar~ ~he cases .
Mrs. Alice Cav~ll'~e 'ca~e Before the Bo~ stating that she was plarming to
operate a beauty parlor iu her h~ae at 70 U~ple Avenue~ but ~efcre she oould.
get a license from the Stato~ the approval of the Board was re~aire~ as te
whether or not this was permissible. Mrs. Cavallaro stated that there were
· fe~ ~_r changes to be made te ~eet the state requirements but it was
neueasary for her to get the approval of the Board before she could do amything,
Mrs., Cavaliers was imfor~ed that it was per~Lssible for her to operate a shop
in her ewe home. provided that there was ne displa~ of goods seen from the street
amd that the only sign that she could have would be one that was not mere than
tw~ feet square in area. She requested that the Board send her a letter stating
these facts se that she would have it inwriting te present to the State Board.
Motion was ~ade and seconded md it was nm~i~usl~ voted that a l~tter be sent
te Mrs. Cavallare~ a copy of which is in the file. Mrs. Cavaliers thanked
the Bear~ f~r their so.potation.
The application ef GUy B. Hewe was then taken tn~o considerattom There was
--ch discussion on the point as to whether er not a motel was a hotel ef the
leasing of roomse Mrs ~hipple read excerpts from the ~n~tes of the Board ef
Appeals in Andover, where ap~,oval for this motel had been refused~ but n~
a~thority coul~ be found te elear up _~h~ points ~1 me~bers were in agreement
that the owner would be ~king his home on the pre~se~ azd although ~he rooms
to be le~sed were not conuecting rooms ~ith the main house~ it was still the
leasing ef reo~s a~ not an ever~ ~ht ea~p~ as defined in the 2~mi~g B~-~aws
which ha~e been written ten years age amd which had a very different meaning
than the ~mdern
After considerable discussion and deliberation,~a ~tien was male and dul~
seoonded and~it was unamh~sl~ vete~ te approve the petition ef ~ B. Howe
~ te authorize the B~ilding Inspector to issue ~ a building pex~it for
· ~otel fe~ the follmr/~g reasonst
Xt ia the opinion ef the Board that the propesad motel with the f~-~2y ef
the owner res~-2 en the premises is considered the leasing ef roo~s ~
· f~=~y residing on the premises as define~ in Article II~ section l~
paragraph (b) of the Zoning By-Laws of the Town of North ~ndover,

Metion was ~ and seconded and it was ,,~-~m~us~7 veted te adjourn
at lOt15 P.M. The next regular meeting to be held in Neve~ber as
the regular meeting night of the Board is a holidaye If applicatiens
are received, a meeting will be called by the Chairmm~
