Dear Sirs
A public hearing was held by the Board of Appeals an June ll, 1973 upon application
of North Andover Skating Club, Inc. who requested a Special Permit under Section
4.129, paras (9) and section 9: para. 9.3 of the Zoning By-Law so as to permit the
construction of a building which will Douse three, 85 x 185, ice skating rinks,
located at the west side of Turnpike Street; approx. 550 feet from the corner of
Willow Street and known as 815 Turnpike Street. The following members were present
and voting: Frank Serie, Jr., Chairman; Arthur Re Drummond, Vice Chairman;
William N. Salemme and Louis DiFruscior and Dr. Eugene A. Beliveau, Clerk.
The hearing was advertised in the Lawrence Eagle-Trlbune on May 26 and June 29 1973
and all abutters were duly notified by regular mail.
Atty. Stephen Duly and Mark Henry represented the petitioners. They explained that
a three rink ice skating, yyoarsround, facility is planned, which will haus a completely
enclosed equipment room so that there will be no noise to the outside. The facility
will be located on a site of 9.23 acres, approximately 550 feet Prom the corner of
Willow Street at Turnpike Street, The parking area will service 30D-500 care and a
number of buses. The entrance will be from Willow Street, opposite the entrance to
the Tennis Club. They have made application to the State D.P.W. to connect to the
existing sewer facility on Rte. 114. They have also filed a plan with the State
D.P.W. for a breakdown lane from Rte. 114 to take care of traffic. An infirmary
and nursery will be provided; a restaurant is allowed as a secondary use. This
facility would not be obnoxious or detrimental in any way and they are trying their
best to take care of any traffic problems.
Several Marian Drive residents were present and were concerned mainly about the
traffic on Rte. 114 and how it would be handled, Mr. Henry explained that the state
couldn't act until some definite action is taken by the Board; that everything is
contingent upon the special permit, including the financing.
Mr. Drummond made a motion to continue the hearing until next month, Dr. Beliveau
seconded the motion and the vote was unanimous,

On dune 18, 1973, the Board members, the petitioners and engineers, B'ighvay Surveyor
William Cyr and Selectmen Guthrie and Coady, met st,the site to view the premises
and walk the area. It was noted that no homes in the Marian Drive area could be
seen from the site.
The Board next met on duly 9r 1973, at which all of the same Board members and the
petitioners were present.
Mr. Salemme made a motion to GRANT the SPECIAL PARMITt subject to conditions; Mr.
DiFruscio seconded the notion and the vote was unanimous. The conditions are as
follows:
le A 300 ft* southbound do-acceleration lane.
2. A transition intersection pavement of Willow Street.
3. A southbound east turn storage lane of 300 feet.
4. A northbound west turn storage lane of 300 feet.
5e Eliminate passing lane (1200 ft.).
6. Replan Willow Street to 4O ft. layout (540 ft.).
7. Lighting for entire storage lane (1200 ft.).
8. Blinker at Mill Street northbound and Willow Street southbound.
9. Low profile island (approx. 4" high)t with "Keep Right" and *Stop" sisna,
all on town property,
10. Willow Street must be level with Rte. 114 for at least 60 feet from the edge
of Rte. 114,
11. Willow Street must be a paved surface of at least 32 ft* wide with drains, etco
to meet existing town requirements and mast be maintained by the petitioner to
the entrance of the skating facility,
12. Parking is to be as specified on the plan and is to be increased as the seating
capacity is increased, in accordance with the Zoning BY-Law.
Under Section 9.31, "Condition for Approval of Special Permit"# the Board found that
in its Judgment all of the following conditions are m6to.
(a) The specific site is an appropriate location for such a uses structure or
condition.
(b) The use as developed will not adversely affect the mei do
(c) There will be no nuisance or serious hazard to vehicles or 'pedeatrians aims
the petitioner must also get state approval for access to Rte. 114.
(d) Adequate and appropriate facilities will be provided for the proper operation
of the proposed use.

Dear Mr. Long:
The Board of Appeals held a pulblic hearing on Monday evening ,
July 12 , 1982 upon the application of Mark 0 . Henry . The hearing
was advertised in the North Andover Citizen on June 24 and July 1 ,
1982 and all abutters were notified by regular mail . The follow-
ing members were present and v ting: Frank Serio , Jr ., Chairman ;
Alfred E . Frizelle , Esq . , Vice Chairman ; Richard J . Trepanier, Esq . ,
Clerk ; William J . Sullivan ; and Augustine W. Nickerson .
The petitioner seeks a variane from the provisions of Section 7 ,
Paragraph 7. 1 and Table 2 of the Zoning By Law to permit the
division of a parcel of land into two lots , each having less than
the required area on premises'I located at 25 Bay State Road .
The petitioner testified that the wishes to divide 18 ,400 square
feet into two 9 ,200 square feet lots in order to construct two
single family dwellings . All other requirements of the Zoning By
Law will be met .
Several abutters spoke in opposition to the request .
A motion was made by Mr. Frizelle and seconded by Mr. Nickerson to
grant the variance as requested. The motion failed to carry; and ,
therefore , the petition is denied .

The principal points upon which I base my application are as follows

The two resulting losts will be 9,200 square•fect each, this is the exact
size of all of the lots in the area. The partitioner wishes to raise the existing
deteriorated building on this property. It is the partitioners feeling that granting_
this variance will not derogate from the intent or purpose of the Zoning-By-Law
and it will not be detrimental to the neighborhood.

Sec. 1 APPLICATION FORM
Every application for action by the Board shall be made on a form
approved by the Board. These -forms shall be furnished by the clerk
upon request . Any communication purporting to be an application
shall be treated as mere notice of intention to seek relief until
such time as it is made on the official application form. All in-
formation called for by the form shall be furnished by the applicant
in the manner therein prescribed.
Every application shall be submitted with a list of "Parties in
Interest" which list shall include the petitioner, abutters , owners
of land directly opposite on any public or private street or way ,
and abutters to the abutters within three hundred feet of the property
line of the petitioner as they appear on the most recent applicable
tax list , notwithstanding that the land of any such owner is located
in another city or town , the Planning Board of the city or town , and
the Planning Board of every abutting city or town .
* Every application shall be submitted with an application charge cost
in the amount of $25 . 00 . In addition , the petitioner shall be respon-
sible for any and all costs involved in bringing the petition before
the Board. Such costs shall include mailing and publication , but
are not necessarily limited to these .
