Decision - Disapproval
Preliminary Plan of Land
Forest Ridge! Estates dated November 1, 1985
1 ) In accordance with Section IV.A c) and d) Location and
Alignment of Subdivision Streets; and Section IV, A, 4a
Dead End Streets, Forest Ridge Preliminary Subdivision
does not; meet the referenced guidelines established in
the Subdivision Rules and Regulations (specifically Road
'A' , 'B@, & 'C' . )
2) A locusplan showing adjoining property was not
submitted to the Board to determine the best possible
extension to service adjoining parcels .
3) Due to the size of the subdivision and proximity of said
subdivision to Route 114, an open space provision should
have been addressed at the preliminary discussion. Any
further discussion and review will require compliance
with Section IV. H. Open Spaces.
4) No access has been provided to land owned by the
Commonwealth of Massachusetts .
5 ) In accordance with Section 4.11(5) of the North Andover
Zoning Bylaw 'no way giving access to a building or use
not permitted in a residential district shall be laid
out or constructed so as to pass through a residential
district. ' Road 'B ' is in conflict with this Section of
the Bylaw and must be clarified prior to any further
review of the site.
6) No documentation has been submitted to the Board
indicating the traffic and environmental impact the
Subdivision will have on Route 114 and wetlands, or
impacts , Route 114 will have on the subdivision and
future ' inhabitants of the subdivision. No alternative
traffic controls have been submitted for review by the
Board.
7 ) Due to the extent of wetlands along Road 'B' and 'C' and
the associated filling and wetland alteration required
to construct the roadway and dwellings may render this
portion; of the subdivision unbuildable.
8) Drainage as shown on the subdivision plans do not appear
adequate to prevent zero increase in run-off.
9) The applicant shall be advised that in the event a
Definitive Plan evolves from this preliminary plan
and/or parcel of land, the North Andover Planning Board
will require upon submittal that all aspects of the
Rules and Regulations Governing the Subdivision of Land
must be strictly adhered to and will be required,
notwithstanding this discision.

Dear Sir:
A public hearing was held by the Board of Appeals on Oetober 159 1973 upon
application of Guy N. Ri.chardsg who appealed the denial of a building permit]
under General Laws, Chapter 4OA9 Section 13, so as to permit business offices
with storage facilities as a secondary use; located on the westerly side of
Turnpike Street, (Rte. 114): approx. 200 feet from the corner of Berry Street
and to the south of 1803 Turnpike Street. The following ambers were present
and voting: Frank Serio# Jr., Chairman; Dr. Bagsne A. Belivesut Clerk; Louis
DiFruscio, William N. Salemme and Associate Member James XcIamisr Seq.
The hearing was advertised in the Lawrence Eagle-Tribuas on September 29 and
October b, 1973. All abutters were duly notified by regular mail.
Atty. John J. Willis represented the petitionerp and explained that Capital Dis-
tributing Co. (liquor distributor) desired to purchase the property from Guy
Richards and erect a new building. He said Building Inspector Foster interpreted
the Zoning By-law as warehousing and wholesaling not being allowed unless it is
a secondary use. Application was made by the petitioner on the basis of providing
sales offices and also a facility to store the materials that would be sold. The
size of the building for the storing of the materials will be larger than the sales
office and a substantial portion of the business is the packaging of bottled liquors.
It is not the wholesale selling of a product. The Building Impactor agrees that
it was an unfortunate choice of wording in the Zoning Hyp-lar and that under the
Previous Zoning Bye-Lam, this type of use would have been allowed. He explained
that there are many things in this exiatiag By-law which are left up to his judgment
and interpretation; that the By-law is not clear in many instances. He agrees that
this would be a desireable business.
Mr. DiFruscio made a motion to take the petition under advisement; Kr. Noble seconded
the motion and the vote was unanimous.

to the town and that this would be a proper location~ especially since this area
has been named for industrial for many years and this type of operation bad been
allowed under the previous Bq+-law.
