The folloiwing petition was heard at a meeting of the Board of Appeals on Tuesday ev ming
October 7.3, 1964 at the Towle Office Building. Members present and voting were&
Daniel T.I OtLeary, Chairman; William Morton, Secretary; Henry E. Lund, Arthur Drt=MQnd
and John We :Shields.
DR. JOHN A• HAWES requested a variation of See. 6, Para. 6.33 of the Zoning By-Law so as
to permit construction of a single floor dwelling, on the premises, located at the west
side of forest Street, .5 mie distant from the corner of Boxford Street, North Andover#
This public hearing was advertised in the Eagle Tribune on September 29 and October 6,
X964. All abutters were duly notified of this hearing by certified mail.
The petitioner appeared before the Board and was without plans that conformed with the
requirements of the Board. However, sufficient explanation was presented to indicate
that the petitioner was the owner of 3.9 anres of .land, bounded by the southwest side
of Forest Street, having a total of 253.1 feet frontage. He outlined that the purpose
of the petition was to provide, as a gift to his son, a lot of land wherein his son
could erect a homestead, retaining close proximity to a family situation.
No other person spoke in favor of the petition.
There was no opposition to the petition.
The petitioner was given explicit instructions to prepare and submit a plan by a Civil
Engineer in conformity with the outlined requirements of the North Andover Board of
Appeals.
Mr, Lund made a motion to postpone the hearing until November 9 when proper plans would
be presented. Mr. Drummond seconded the motion and the vote was unanimous.
On November 9, 7964, the petitioner presented in person, to the Board, a plan of land

acres into Lot 4k and Lot 5A.. It was explained that the proposed site of the intended
future residence would be located on lot 5A and would be set not less than 200 feet
from theefront street line and that the area of 960 feet frontage by the depth of
162 feet, as shown on said plan, is densely wooded.

In Executive session, the Board found that the premises are located in a Rural Resi-
dential zone as defined by the Byb-Law, which requires a street frontage of 150 feet
and a loft area of 44,000 sq. ft. (Sec. 6.33)•
That the applicant is a professional Doober of Dentistry and that his aims in re-
questing the variance were not for commercial or promotional reasons, but purely to
provide 'ia site and home for his son.
That the total paroel of land presently owned by the petitioner is far in excess of the
requirements of the Zoning By-Law.
That in the Rural Residential zone, there are many nonwoonforming lots with less than
the zoning requirements and with less area than lot 5k possesses, mainly 9400 street
frontage and a total of 1.8 acres, and while the street frontage is less than is re-
quired, the total area is almost twice the minimum requirements.
That, were the requested variance to be granted and a dwelling to be constructed upon
the parcel as the applicant intends, no observable zoning non-conformity would appear
to any passer-by nor to any adjacent land owner.
That, to deny this petition, this additional lot can not be used for any purpose under
the Zoning By-Law and the town as well as the applicant would suffer hardsbi.p.
Therefore, under motion made by Mr. Drummond and seconded by Mr. Lund, it was carried
unanimously to GRANT the petition*
