Dear Mr. Long :
The Board of Appeals held a public hearing on Monday evening ,
July 13 , 1981 upon the application of Frank Gelina's . The
hearing was duly advertised in the North Andover Citizen on
June 25 and July 2 , 1981 and all abutters were notified by
regular mail . The following members were present and voting
at the public hearing and again on July 21 , 1981 when the Board
rendered its decision : Frank Serio , Jr . , Chairman ; Alfred E .
Frizelle , Esq . , Vice Chairman ; William J . Sullivan ; Augustine W .
Nickerson ; and Raymond A. Vivenzio .
The petitioner , an engineer , seeks a variance from the provisions
of Section 7 , Par . 7. 3 and Table 2 of the Zoning By Law . The
petitioner said that he made a mistake and that a dwelling was
constructed too close to the lot linea
Upon a motion made by Mr. Frizelle and seconded by Mr. Nickerson ,
the Board voted to deny the variance .
The Doard finds that the petitioner did not present satisfactory
evidence to conform with the provisions of Section 10 .4 of the
Zoning By Law .

Every application for action by the Board ' shall be made on
a form approved by the Board. Thcse forms shall be furnished by the -
clerk upon request. Any co.2-R,nication purporting to be an application
shall be treated as mere notice of intention to seek relief until such

,Dear Mr . Long :
The Board of Appeals held a public hearing on Monday evening ,
August 10 , 1981 upon the application of Edward. A. Plugis, Jr
The hearing wad advertised in the Lawrence Eagle Tribune on
July 27 and August 3 , 1981 and all abutters were notified by
regular mail . The following members were present and voting :
Frank Serio , Jr. , Chairman ; Alfred E . Frizelle , Esq . , Vice
Chairman ; Richard J . Trepanier , Esq . , Clerk ; Walter F . Soule ;
and Raymond A. Vivenzio , Esq.
The petitioner seeks a variance from the provisions of Section 7 ,
Paragraph 7 . 3 and Table 2 of the Zoning By Law. He introduced
evidence through his attorney to show that the house was placed
too close to the lot tine because the engineer made an error in
determining the lot line .
Upon a motion made by Mr. Trepanier and seconded by Mr. Frizelle ,
the Board voted to grant the variance as requested.
Tho Board finds that each of the conditions set forth in Section
10 . 4 of the Zoning By Law have been satisfied. Said variance
will not , in the opinion of the Board , derogate from the intent
and purpose of the Zoning By Law.
