The following members were present and voting: Frank Serio, Jr. , Chairman, Walter Soule, Clerk, Anna O'Connor and John Pallone. The hearing was advertised in the North Andover Citizen on May 27 and June 3, 1992 and all abutters were notified. Upon motion by Mrs. O'Connor and seconded by Mr. Soule, the Board voted unanimously to GRANT the variance as requested. The Board finds that the granting of this variance will not adversely affect the neighborhood or derogate from the intent and purpose of the Zoning Bylaw. Dated this 18th day of June, 1992. Long: The North Andaver Planning Board held a public hearing on Wednesday evening , March 2 , 1988 upon the application of Borden Chemical , 1 Clark Street , North Andover , MA. The hearing was advertised in the North Andover- C .tizen on February 11 and February 18, 1988. The following members were present and voting: Chairman, Paul Hedstrom, George Perna, Vice-Chairman; John Simons, Clerk ; and Erich Nitzsche. John Burke was absent . The petitioner seeks a Special Permit under Section 8.3, Site Plan Review. The purpose of the site plan is to review the proposal to construct three (3) additions to an existing structure, 1 ) 120 ' 11 ' x 8316" , one story, height 35 '6" , 2) 90 ' x20 ' , one story , height 15 ' , and 3) 56 ' x201 ' 4" , finished height of 25 ' 6" . Said additions are for warehouse, processing areas and office space, on 16.2 acres, more or less, located on the East side of Clark Street with frontage of 955.33 feet , in an Lndustral--2 ( I-2) Zoning District . -john Simons read the legal notice to open the public hearing . Letters were received and read from the Board of Health and the Conservation Commission. Rick Taylor , Culter Associates of Worcester , presented the Board with the plans and gave an overview of what was being proposed . There are three additions , one is an expansion to the existing office which is on the second floor , looking to add 1 ,800 square feet . The second addition being proposed is the processing addition and the third a warehousing addition . The site is at i CLark Street . At present , there are 20B parking spaces available, once the additions are added there will be 201 parking spaces. There are six loading docks, the only difference is that they will be relocated . Paqe 2: Paul' Hedstrom asked what the total square footage of the additions would be . Mr . Taylor stated that the warehouse addition was 11 ,200 square feet , the processing addition was 10,100 square feet and the office was 1 ,800 square feet . George Perna questioned the height in regards to the Airport . Mr . Taylor cited towers in excess of 45 feet high . He did not believe that there was an impact to the approach to the Airport . Scott Stocking , Town Planner asked if they had received any letters or sent any letters to the FAA for comments or the Airport Authority. Mr . Taylor said that they had been sent . John Simons asked if there was any section of what it would look like. Mr . Taylor showed them to John. George Perna said that the Board was mainly interested in what it looked like from Route 125 at Clark Street . Mr . Taylor said that it would not be visible. George Perna wanted to know the height of the existing structure. Mr . Taylor said that it was 25 ' 6" ana that the highest addition Would be 35 feet . Profiles and elevation of the building were requested by the Board . The applicant has an Order of Conditions from Conservation. John Simons questioned the response from the Board of Health regarding these additions and would they add more toxic substances. Mr . Taylor said as far as he knew, nothing that they are doing now will change. Erich Nitzsche said that the Board of Health ' s concerns should be part of the conditions. Scott Stocking stated that there were potential drainage concerns on Clark Street to a culvert that is not the proper size. Bill Hmurciak , Public Works Department , said that the culvert in question was further down on Clark Street , closer to the Airport and would be addressed on the Butcher Boy site . The applicant is to provide pictures of elevations and letters from the FAA and Airport Commission. MOTION: By John Simons to close the public hearing and take the matter under advisement . The proposed additions to the existing structure are appropriate given its use, location and operation of the plant . 2. The proposed additions will not adversely effect adjacent properties ertie or structures. 3. The Board finds that the proposed addition will not present a nusiance or hazard to the general public . 4 . The applicant has provided appropriate facilities for the proper operation of the proposed use. 5. The Special Permit application adheres to the requirements of Section 8.3 (Site Plan Review) . Based upon the findings made above, the Board conditionally approves this Site Plan Review Special Permit with the following conditions: 1 . Five handicapped spaces shall be clearly marked on the site plan and on the pavement in the existing parking lot . 2. The applicant shall provide the Planning Board letters from the Lawrence Airport Commission, and the FAA that the project adheres to their rules and regulations prior to the issuance of a building permit. 3. Note placed on the plan that all processes, storage and procedures in manufacturing adhere to all State and Federal Regulations. 4. Changes made to the notes on the plan which adhere to the actual conditions found on-site. 5. Any changes in the site plan required by action under M.G.L. Chapter 131 , Section 40, shall be resubmitted to the Planning Board for review. 6. Applicant shall file a statement with the Board of Health that no new chemical processes or hazardous materials shall be stored in the facility as a result of the proposed addition. 7. Any 'changes made to the site plan after they have been filed with: the Registry of Deeds Office, shall be submitted to the Planning Board for review. Mr. Pendergast, General N?anager of Borden Chemical Company spoke on behalf of the Company. They desire to build the addition which will give added flexibility to the operations of the Company. If the Board does not allow the variance, they would have to build at one of their plants in some other part of the country. The 220 foot building is the minimum length required to house the necessary process equipment fort s expansion. This will afford Borden the maximum increase in productive Capacity within its property lines Consistent with efficient and economi- Cal processing. It would allow Borden the flexibility of still future expansion and permit construction to proceed without disrupting the continuity of its present pro- duction. A building perA.it has been issued by the Building Inspector for an addition that will terminate 50 feet from the rear lot line. The plans showed the addition coming within .00 feet of the rear lot line. ,A variance is needed for the additional 20 feet. There was no opposition to the petition. In Executive session, after thorough discussion, Mr. Morton made a motion to GRANT the variance, Mr. Deyo seconded the motion and the vote was unanimous. The Board granted the variance for the following reasons. I.
