Dear Mr. Long:
The Board of Appeals held a public hearing on Monday evening, June 11,
1984 upon the application of 'Bulger Animal Hospital. The hearing was
advertised In the North Andover Citizen on May 24 and 31, 1984 and
all abutters were notified by regular mail. The following members
were present and voting: Alfred E. Frizelle, Esq. , Vice Chairman;
William J. �ullivan; Augustine W. Nickerson; Walter F. Soule; and
Maurice S. `foulds .
The petitioner seeks a- variance from the provisions of Section 7 ,
Paragraph 743 and Table 2 of the Zoning By Law so as to permit
relief from] the rear setback requirement to allow the construction
of an addition on premises located at 247 Chickering Road in the
General Business (GB) zoning district.
Dr. John Prentiss testified on behalf of the hospital that the pro-
posed addition will consist of an examining area, intensive care
areas , a puppy kindergarten and second floor living quarters for an
intern. The proposed addition will be setback fifteen (15) feet
from the rear lot line.
Neighbors expressed concern about increased noise from the hospital
as a result of the proposed addition.
upon a motion made by Mr. Foulds and seconded by Mr. Nickerson, the
Board voted unanimously to grant the variance subject to the following
conditions:

1. The obedience training school be conducted inside the building.
2. Suitable soundproofing be implemented in the construction con-
sistent with that already in the existing structure on the South
side of the existing building, being the existing run area.
In granting the variance, the Board finds that Section 10 .4 of the
Zoning By Law has been satisfied. In particular, the Board finds
that the petitioner does not own sufficient land in the GB zone
to accomodate the needed addition so that denial of the variance
would create a hardship to the petitioner. Further, the Board
finds that desirable relief may be granted without nullifying or
substantially derogating from the intent and purpose of the Zoning
By Law.

The Board of Appeals held a public hearing on Monday evening ,
September 19 , 1983 upon the application of Bulger Animal Hospital .
The hearing was advertised in the North Andover Citizen on Sep-
tember. 1 and 8 , 1983 and all abutters were notified by mail

The peti,'tioner seeks a variance from the provisions of Section 6,
Paragraph 6 . 6 (5d) of the Zoning By Law so as to permit the erec-
tion of sign which will not meet the setback requirements on
premises, located at 247Chickering, Road'.
Dr. JohnI Prentiss represented the hospital and testified that the
sign is necessary because the hospital is difficult to find due to
the many trees surrounding it . In addition , due to the berm and
curb cut , the sign cannot be placed elsewhere .
He is proposing to erect the sign above the island in front of the
hospital. The proposed sign will be approximately 10 feet from
the ground , inside the property line , but overhanging on State
property. A variance from the required 10 foot setback is requested .
The Board voted to take the petition under advisement .
On October 17 , 1983 , the Board rendered its decision with Members
Serio , -Frizelie , Trepanier , and Associate Members Soule and Foulds
again present and voting .

Upon a motion made by Mr. Frizelle and seconded by Mr . Trepanier,
the Board voted unanimously to grant the variance from the 10
foot setback requirement subject to the conditions that the
sign post be placed on the petitioner' s property and that the
sign hang over the petitioner ' s property with no part hanging
over State property.
The Board finds that Section 10 . 4 of the Zoning By Law has been
satisfied'. Specifically , the Board finds that a-literal enforce-
ment of the By Law will involve a substantial hardship to the
petitioner and that desirable relief may be granted without
substantial detriment to the public good and without nullifying
or substantially derogating from the intent and purpose of the
Zoning By Law.

1 . A six-foot stockade fence to be installed on the Northerly
and rear side of the lot .
2 . On the Southerly side , there will be a natural evergreen
tree barrier that will grow to a suitable height to provide
necessary screening .
3. The two Southern most parking spaces will be eliminated .
4. A chain or gate barrier will be installed to secure the
parking area at ingress/egress ,
5 . A suitable barrier on the island between the ingress/egress
will be installed to provide unauthorized entrance to the
parking lot .
6 . The parking lot will be used only, for the business purposes
of the animal hospital and the residents of the home and
their 'guests .
7. All conditions to be placed on the plan and the plans to be
revised accordingly - to be submitted to the Board of Appeals
no later than February 8 , 1982 . No plans will be endorsed
until such revisions are made .

The Board of Appeals held a public hearing on Monday evening,
January 11 , 1982 upon the application of Winifred A . Bulger .
The hearing was advertised in the North Andover Citizen on
December 24 , 1981 and January 7 , 1982 and all abutters were
notified by regular mail . The following members were present
and voting : Frank Serio , Jr . , Chairman ; Richard J . Trepanier,
Esq . , Clerk ; William J . Sullivan ; Augustine W . Nickerson; and
Raymond A . Vivenzio , Esq .
The petitioner seeks a variance from the provisions of Section 7 ;
Paraqraph7 . 3 and Table 2 of the Zoning By Law to allow the
continueid 'use of the existing buildings and to construct an
addition with additional parking , having less than the required
set backson the premises located at 247 Chickering Road . A
sinole family home and an attached animal hospital are located
on the property .
The petitioner testified, through counsel that the Building
Inspector ordered the occupants of the animal hospital to
eliminate the noise caused by barking dogs from the open runs
located behind the hospital . The petitioner proposes to eliminate
said runs and replace them with an enclosed dog run to the rear
of the existing hospital . The petitioner also testified that
additional parking is needed on the South side of the premises
for both clients and employees .

In addition , a side line and rear line variance is requested for
the existing single family dwelling , as it does not conform to
current zoning regulations .
Several neiahbors were present at the hearing and voiced concern
that the larder parking area might attract unauthorized traffic
and parking from a neighboring restaurant .
Upon a motion made by Mr. Sullivan and seconded by Mr . Vivenzio ,
the Board voted unanimouslyy to grant the variances requested for
the existing dwelling and proposed addition with additional
parking with the foliowing conditions
1 . A six -foot stockade fence to be installed on the Northerly

The Board finds that each of the provisions of Section 10 . 4 of the
Zoning By Law have been satisfied . In particular , the Board finds
that due to the location of the existing dwelling on the premises
for many years with a slight deviation from the existing require-
ments , together with the order from the Building Inspector that a
daily fine will be initiated if the noise is not eliminated , con-
stitutes a hardship within the definition of the Zoning By Law.
