Dear Sir: The North Andover Board of Appeals held their regular meeting in the Town Office Building on Tuesday, July 7v 1970 with the following members present and voting: Arthur R. Drummond, Chairman; Daniei T. O'Leary, Secretary; Donald J. Leonard, J. Philip .krsenaaltj Zsq. and James A. Glynn, Jr., Esq., Associate Member. CHARLES CONSTRUCTION COMPANY requested a variation of Section 4.41 of the Zoning By-Law and to appeal the decision of the Building Inspector so as to permit the construction of a building to be used for the assembly, repair and sale of power machines and motorized equipment on the west side of Sutton Street, 400 feet from the corner of gain Street and known as 200 Sutton Street. The public hearing was advertised in the Lawrence Eagle-Tribune on June 20 & 271 1970 and all abutters were duly notified. Atty.. John J. Willis represented Charles Construction Company and stated that the use proposed is necessary and incidental to,the business which is allowed in the Industrial zoning' district and retailing would not be the principal business of the company. Edward Phelan, member of the Board of Assessors and the Industrial Development Commission, spoke in favor of the variance, relating the attempts to have new industry settle in town and utilize the land that had not been developed to its full potential. There was no opposition. Following discussion while under advisement, the Board, upon motion of member Glynn, seconded by member O'Leary, voted unanimously to approve the petition inasmuch as the requested variance will not be in substantial derogation from the intent or purpose of the Zoning By-Law. Gentlemen: The application for a building permit by Charles Construction Company to erect a building on Sutton Street was refused because their application showed that retail selling would be done at this location. The Zoning By-Law under Sections 4.41 and 4.44 clearly limits retail selling in industrial areas to specific uses spelled out by said sections and then only after a site plan review by the Zoning Board of Appeals.
