Wilbur J. Harvey Dear Sir: Upon application of Wilbur J. Harvey', owner of the above- captioned property, wherein a variance was sought from the requirements of the Zoning Ordinance under Section 7.22, a hearing was held on 19 September, 1966, at 7:30 P.M. in the Town Hall facilities. Members present and voting were John J. Shields, Chairman, James Deyo, Secretary, Daniel T. OtLeary, Arthur Drummond, and Donald Scott, Mr. Wilbur J. Harvey represented himself and pleaded his ap- plication. The application for a variance encompassed the demolition of a present, obsolete garage, and for the erection of a new garage wherein the proposed structure would be less than the required distance as provided by Section 7.22 of the Zoning Ordinance. The application of the applicant was advertised in the Lawrence Eagle Tribune under date of 3 September and 12 September, 1966. All abutters were duly notified of this hearing by, certified mail. Mr. Harvey appeared before the Board explaining that the present structure is located one foot from the present lot line, that it is in a state of physical condition necessitating its demolition since the reconstruction of same would be economically unsound. He further ,stipulated that he had suffered a heart attack and that the proposed location was closer to the street front line but within the required set-back limitations from the street front; that being allowed this, it would enable him to house his automobile in a garage, especially during the winter months which the new location would out down to approximately, one third the distance of the driveway length. Pag, II HARVEY The present driveway could be utilized without requiring additional street opening. lh% Harvey Further stipulated that it would not be in derogation to the neighborhood since many other similar type structures are in non-conforming set-back situations in the immediate neigh- borhood,, and that he would sustain severe hardship, particularly in view of his physical condition, if the permit were denied. There were no other proponents heard on the application, nor were there any opponents to the application. Upon motioni and seconded, the application was taken under ad- visement . 'During an examination review and evaluation of the application, there was sufficient knowledge among members of the Board that the pleading of Mr. Wilbur J. Harvey was confirmed by personal knowledge. Member Daniel T. DtLeary made a motion to approve the applica- tion. The motion was seconded by Member James Deyo and the vote was recorded as unanimous. The reasons ,for approval are as follows: _ ) Approval shall in no way be detrimental to the immediate neighborhood influences; b) That approval is not in derogation to the intent and Purpose of the By-Law; c) That to deny this application would cause substantial hardship, both financial and otherwise, to the applicant.
