Dear Sir:
The following petition was heard at a meeting of the Planning Board on Wednesday
evening, May 31, 1972 at 7:30 P.M. at the North Andover High School Auditorium.
Members present and voting were: Charles W. Trombly, Jr., Chairman; Donald N.
Keirstead, Vice Chairman; Fritz Ostherr, Clerk and William Chepulis. John Monteiro
was able to attend the meeting only briefly and was unavoidably called away.
EDWARD W. PHELAN petitioned to change from Industrial District to General Business
District a parcel of land owned by Guy N. Richards on Turnpike Street (Rte. 114)
containing approx. 70 acres and having approx. 3,000 feet frontage.
There were 75-100 people present for the hearings of the evening. Atty. Sam Richards,
of Westford, represented Guy Richards and stated that Mr. Richards had been unable to
develop the land industrially for the past 9 years and that it seemed logical to
develop it for business use. The state forest is the main abutter and this area
would not be a problem to anyone. They do not have any firm commitments but it could
be developed as a shopping center. Several people spoke in opposition stating more
shopping centers were not needed in town; there would be a worse traffic problem than
already exists.
The petition was taken under advisement. The Board held a special meeting on Monday
evening, June 5, 1972 at the North Andover High School with the same members present
and voting. Mr. Keirstead made a motion to recommend UNFAVORABLE ACTION; Mr. Chepulis
seconded the motion and the vote was 4-1, with Mr. Monteiro voting against the motion.
The Planning Board gave the following reasons for unfavorable recommendation:
1. It is the policy of the Board not to establish any new General Business districts
in town.
2. This is not an appropriate location for a commercial use.
3. The area proposed is larger than what would be required in any proposed use at
this time.

The following petition was heard at a meeting of the Planning Board on Monday
evening, February 2$, 1972 at 7:30 P.M. in the Fire Station meeting room. Members
present and voting were: Charles W. Trombly, Jr., Esq., Chairman; John J.
Monteiro, Secretary; William Chepulis and Robert J. Burke.
EDWARD J. PHELAN petitioned to amend the North Andover Zoning By-Law by changing
from Village Residence to Industrial "L" a parcel of land at Belmont and Marble-
head Streets.
Mr. Edward Phelan spoke in his own behalf and explained that his family's plumbing,
heating and air conditioning company is located in the old building near Grogan's
field. The building has been there for many years and has always been used for
some type of business. He said they need office space and they would extend the
building at the ramp area; there would be no other major changes, except to improve
the property. It is presently a non-conforming use and no expansion can be made
unless the area is re-zoned. He explained that their type of business is mostly
contract work and there is very little traffic involved.
Several abutters asked questions and were concerned because of the playground
nearby and the number of children in the area; also that if the property ever
changed ownership almost anything could be put in there is the area was re-zoned.
Mr. Monteiro made a motion to take the petition under advisement; Mr. Burke seconded
the motion and the vote was unanimous. The Board will vote on the petition at a
meeting to be held on March 6, 1972.
The Planning Board met again on Monday evening, March 6, 1972, with the same members
present. Member Donald N. Keirstead was also present but did not vote on the
petition since he did not sit at the hearing. Mr. Monteiro made a motion to
recommend FAVORABLE action; Mr. Burke seconded the motion and the vote was 4-0.
The Board gave the following reasons:

1. ' Land is similarly zoned directly across the street and this would be an extension
of an already existing zone.
2. This type of zoning would not be detrimental to the area since this type of use
has existed in this particular area for many years.
