Dear Sir:
The following petition was heard at a meeting of the Board of Appeals on Monday
evening, November 8, 1965 at the Town Office Building. Members present and voting
were: Daniel T. O'Leary, Chairman; William Morton, Secretary; Arthur Drummond,
John J. Shields and James Deyo.
HOWARD T. I RUH requested a variation of See. 7.23 of the Zoning By-Laws so as to
permit the erection of a single family dwelling, on the premises located at the
easterly side of Highland View Avenue, known as Lot #89 on Plan of Highland View
Park.
This public hearing was advertised in the Eagle Tribune on October 25 and
November 1, 1965. All abutters were duly notified by certified mail of this
hearing. Atty. ;Ralph E. Finck represented the petitioner, who was also present.
This lot is 45x100 sq. ft. and there is no other land available. Mr. Heath has
owned this lot since 1956 and desires to erect a house with set backs of approx.
10 feet on each side and 27 feet in the rear. The front set-back conforms. There
were six abutters present protesting building on small lots, but the Board in-
formed them that a State law allows construction on small lots if now other land
is available and that the petitioner could build without the necessity of a
hearing if he met the set-back requirements.
In Executive session, after thorough discussion, Mr. Morton made a motion to GRAFT
the variance with the stipulation that the front and rear egress conform with the
floor plan as submitted. Mr. Deyo seconded the motion and the vote was unanimous.
The Board voted, to grant the variance for the following reasonsa
a. The proposed dwelling, with the set-backs as requested, would not be in derogation
to the neighborhood.
b. There exist certain conditions especially affecting the parcel in question,
which do not generally affect the entire zoning district in which the parcel is
located.

e. The Board sees no derogation to abutting properties or to existing neighbor—
hood influences.
D. To deny the, said petition would result in a substantial hardship, financial
or otherwise.
e. No observable zoning non—conformity would appear to any passerby, nor to any
adjacent landowner.
