Dear sir: JECISION The Board of Appeals held a Public Hearing on Monday evening, December 9, 1957 on the application of Lenley M, Hensh" at ux, for a special permit under the provisions of Section 6.2 of the Zoning By-Uw so -as to permit the division of property into two lots on the premises of said Lenley M. Henshaw, et ux, located on Johnson Street, North Andover, in accordance with a plan on file with said Board of Appeals.. This Public Hearing was advertised in the Lawrence Evening Tribune on November 27, 1957 and the abutters were duly notified. The members present and voting on this application were: Donald F. Smith, Chairman; Daniel OtLeary, Henry E. Lund and Nicholas F. Nicetta. Mr. Lund made the motion to grant the special permit, seconded by Mr. O'Leary and voted unanimously by the Board for the following reasons: No one appeared in opposition to the application. It appears to the Board that the land was divided in accordance with a plan which has pre- viously been filed with the Registry of Deeds, which plan was endorsed as not requiring the approval of the Planning Board of the town of North Andover. It further appears that relying upon this plan, the petitioner applied for and was granted a building permit by the Building Inspector. It further appears to the Board that the petitioner had begun con- struction upon the building for which the permit was granted, and at the time of the hearing was approximately 75% complete. Because of the endorsement of the plan by the Planning Board and the subsequent action by the petitioner relying upon his building permit, it would be inequitable to deny this application. Furthermore, in view of the fact that each lot concerned satisfies the area requirements for lots in the zoning district and lacks only the necessary frontage bounding on a public way, the Board determines that the petitioner has done everything that is possible to conform as nearly as could reasonably be expected in complying with the requirements of the By-Law.
