Dear Sir: Upon application of Stanley Hughes, 139 Cotuit Street, North "ndover, Massachusetts, for a variance to the Zoning By Law to permit the erection of a single stall garage, 241 from front lot line, the Zoning Board of Appeals heard said application and petition on the evening of November 14, 1966, at 7:30 P.M. The hearing was heard in the Town Office Building. Members present and sitting on this application were John J. Shields, Chairman, Daniel T. OtLeary, Arthur Drummond, Donald Scott, and Howard Gilman, Associate Member sitting for James Deyo. Mir. Stanley Hughes presented his own plea for the adoption of his application. Mr. and Mrs. John G. Partridge of 129 Cotuit Street appeared in opposition. The petition of the applicant was advertised in the Lawrence Eagle Tribune under date of October 31 and November 7, 1966. Mr. Stanley Hughes presented a plea to the Board for the granting of a variance to allow the erection of a one car garage which when erected would be 23.11 from the street front lot line. This proposed garage is shown on the site review plan accompanying the application. In his plea lir. Hughes outlined the fact that the terrain dropped severely at the rear elevation of the present lot and that if he were forced to construct the attached garage within the minimum front set-back requirements, it would block and ventilation ht lig a t lation Prom his kitchen window; and that to so erect the garage as indicated would create a financial hardship to him. R DECISION Page II Hughes Mr. and Mrs. Partridge, as . an abutting neighbor, appeared in opposition stating that if the application were appy owed, it would shut off a view for them watching their children up and down Cotuit Street. No other persons appeared either in favor or opposition to said petition. The application was taken under advisement by vote; and under advisement, it was moved to delay action on the application until all members of the Board sitting had an opportunity to view the site. The petition was tabled until the regular meeting to be held on December 12, 1966. On the evening of December 12 at 7:30 P.M. there appeared before the Board a number of the residents of Cotuit Street. The Chair- man advised all present that the legal hearing had been held with all abutters duly notified; and that the hearing had been concluded on the evening of November 14. However, in the interest of extending every reasonable courtesy to the citizens of the community, the Chairman ruled that any person present could address the Board, and the Board would consider their comments for whatever weight they might carry bearing in mind that the actual hearing had been closed previously. Several neighbors of Cotuit Street and of the applicant spoke in favor of the Board granting the application to allow the erection of the garage as requested by the petitioner. One person present, Mrs. Elliott of Cotuit Street, addressed the Board in opposition. Mrs. Partridge, previously at the original hearing, requested to address the Board, but the Chair ruled against since she had been given adequate opportunity to present her objections to the Board at the time of the official hearing. When all present had exhausted their desire to present their comments to the Board, it was voted to take the matter under advise- ment; and in executive session, and upon motion of Mr. Daniel O'Leary seconded by Member Arthur Drummond, it was voted that the petition be denied. The vote to deny the petition included Chairman John J. Shields, Daniel T. OtLeary, Arthur Drummond, and Donald Scott. Associate Member Howard Gilman abstained from voting. ppppp� DECISION Page III Hughes . i The principal reasons for denying this variance are: a) That no severe hardship, financial or otherwise, was proven; b) That approval of said variance would, in the opinion of the Board, derogate from the intent and purpose of the existing Zoning By-Law; c) That the Board feels the petitioner can accomplish his objective in erecting a one car garage without dis- turbing the light and ventilation of his present structure and remain in conformity with the Zoning By-Law.
