Lyons, Town Clerk Petition No. 15_$67 Town Office Building North Andover, Mass. 373 Salem St. North Andover, Mass. Dear Sir: Benjamin A. Kalinoweld Upon application of Benjamin A. Kalinowski to the North Andover Board of Appeals for a variance under Section 6.33 of the North Andover Zoning By-Laws, so as to permit the division of a parcel of lend into two lots having the required area but less than the required frontage, a public hearing was held on August 14, 1967 by the North Andover Board of Appeals. The bearing was held in the Town Hall facilities after having been advertised in the Lawrence Eagle Tribune on the dates July 29 and August 5, 1967 and with all abutters duly notified by certified mail. The members of the Board present and voting weret James A. Deyo, Chairman; Arthur Drummond, Secretary; John J. Shields, Daniel T. O'Leary and Donald J. Scott. The petitioner argued his own case stating that it was itis desire to create a second lot to be used by members of his immediate family. He pleaded that his lot of land was sufficiently large to warrant being divided into two parcels earls having sufficient area but with the frontage posing a problem. There were no objections beard. A motion was made and carried to take the petition under advise- ment. During the period of_discussion it was noted that to divide the lot as requested would create two lots both severely lacking in required frontage. It was pointed out that an easement on one side of the existing lot would probably be satisfactory* to the petitioner in that it would give hia the interior lot desired. Accordingly, Mr. Kalinowski was requested to vary his petition to the extent that he would request the granting of an easement into the proposed interior lot. At a later sitting of the Board on September 18, Mr. Kalinowski presented the Board with re- vised plans as suggested. A motion was made by member O'Leary, seconded by Member Burka, that the petition be gvanted with an easement to permit access to the interior lot. The motion was carried unanimously.
