ZILM LMOK and LDRUTA V L U petitioned to amend the North Andover Zoning Bey-Leer by changing from Rural Residence zone to General Business a parcel of land on Pleasant Street, bounded by land of HLffser Realty, Inc. YACabe and visage JAAd Company. Atty. Jobn J. Willis represented the petitioners. 'There was no opposition. one person just questioned the attorney regarding parking spec®. The Board voted as follows: Mr. Gilm= mads a motion to APPROVE the petition and Mr. Burke seconded the motion. The vote was unanimous. The reasons for approval are as follows: 1. This area has been used for business. 2. This would be zoning an extension of an existing business area. 3. Dear Sir: The following petition was heard at a meeting of the Planning Board on Monday evening, February 23, 1970 at 7:30 P.M. at the Town Office Building. Members present and voting were: William Chepulis, Jr., Chairman; Robert J. Burke, Vice Chairman; Donald N. Keirstead, Secretary; George B. Farley and Charles W. Trombly Jr., Esq. (Mr. Burke disqualified himself from sitting on this petitionj. JOHN J. LYNCH petitioned to amend the North Andover Zoning By-Law and Zoning Map by changing from Village Residential and/or Industrial to General Business two parcels of land owned by Village Land Company on Chickering Road adjacent to Haffner Realty Trust, bounded°.' by Davis Street and East Water Street. Atty. Harold Morley, Jr. represented .the sellers and proposed purchasers of the area. Parcel No. 1 contains approx. 7 acres of land presently zoned Industrial and Parcel No. 2 contains approx. 2 acres of land presently zoned residential. They propose a Colonial type specialty shopping center. Sewer and water are available. They plan to spend.approx. $700,000 on the shopping center. Several people spoke in opposition to the petition. The principal reasons for opposing were traffic hazard and problem and the values of the homes in the area would be affected. The Planning Board met again on Friday evening, February 27, 1970 with the same members present. Mr. Farley made a motion to recommend favorable action. Mr. Trombly seconded the motion. (Mr. Burke disqualified himself from voting). Mr. Trombly, Mr. Farley and Mr. Keirstead voted yes and Mr. Chepulis voted no. The vote was 3--1 for favorable action . The reasons are as follows: 1. The general character of the area is business and this re-zoning would not effectively change the area. 2. Lyon$, Town Clerk Town Building North Andover, Massachusetts Dear Sir: The fo7lc�ring petition was heard at a meeting of the Board of Appeals on Norday ev+arcing, August 23, 1965 at the Town Office Building. Members present and voting were:, Daniel T. OtLeary, Chairman; William Morton, Secretary; James Deyo, John J. 6bields and Arthur Drummond. LTNCH & UILTIS requested a variation of Sec. 7.3 of the Zoning By Law so as to permit an additipn ,261 x 20t, to an existing building 281 x 361 on the premises, located at the north side of Pleasant Street; at the northwest corner of Trenton Street and known as yo. 180 Pleasant Street. This public ,hearing was advertised in the Eagle Tribune on '&ugust 9 & 16, 1965. ,All abutters were duly notified. by certified mail of this hearing. Atty. John J. Willis spoke on his own behalf. Atty. John Lynch was also present. Atty. dills explained that they thought they had sufficient space and were issued a building permit but upon a check made by the Building Inspector and a subsequent check by an, Engireer, it was found to be 9 feet less than what was required; therefore, a 16 ft. variance is necessary. They cannot make the drug store smaller because they mist meat Etat-0 requirements as to the regulations for size. If this variance werer`to be denied) it would constitute a severe hardship upon the petitioner because the poxilon that is built would have to be torn down. The drug store is strictly for prescription use - there will be no fountain. The present grassed. area will be hot-topped for a parking area in front of the building. There were six people present. Four people were recorded in favor of the petition. There was no opposition. Atty. Willis presented a petition to the Board signed by sixteen abutters and neighbors as approving the granting of the variance. In itlecutive session, after thvrough discussion, Mr. Shields made a motion to GRANT �t1.e Variance, r7r* .Morton seconded the motion and the vote was 4 to 1 with Mr. Deyo voting against the granting. The Board wanted. the variance for the following reasons; 1.
