Variance Application / Section 9—Written Documentation
A. We are requesting a variance for the front, right side and rear setback dimensions
required for constructing a detached garage.
B. We would like to rebuild a detached garage. Our land is relatively wide and''
narrow. The land to the North and Southeast is used for our house and is very
close. There is not enough land to build a garage on this side. The other side of
our house has the needed space(the land is situated South and Northwest).
However, based on its previous footprint,the garage would be very close to the
side set-back requirement.
C. We lost our garage back in March due to severe weather. We were forced to raze
the garage in fear of additional damage, or worse, bodily harm. Since then, we
have had to store household/lawn equipment on our porch. We do not like our
situation of storing gas related equipment in our house; it is too dangerous. We
cannot continue to use our porch in this manner.
D. The missing garage has left quite an open area on our street. One of our abutting
neighbors will be pleased to the new garage in order to regain a little privacy.
Generally speaking,the garage will add back the property value it once had. We
are confident that our neighbors would appreciate the completed garage.
E. We are simply looking to replace our original garage that collapsed with a new
garage built up to today's code.

dwelling unit per acre and said dwelling and associated lot shall conform to all the regulations
consistent with development in the R-2 Zone. Further, under no circumstances shall
multi-family development be allowed in the Village Residential Zone, regardless of density,
without the provisions ofpublic sewer or a town approved and accepted private sewer system.
13. In instances where a lot fronts on Route 114, for purposes of public safety, the required lot
frontage shall be 250 feet.
14. The dimensional criteria described in the table below applies only to detached single family

Special Permit Application /Section 9–Written Documentation
1. We are requesting a special permit for the extension of a non-conforming lot. The
tot is to be used as a detached garage replacement.
2. The specific site for the detached garage is based on a previously existing site that
once was appropriately zoned.
3. Since the location is on a private way with little to no traffic(local residents o

The North Andover Board of Appeals held a public hearing at its regular meeting on Tuesday,November 13,2001 at
7:30 PM upon the application of David&Jennifer Meech,i8 Wiley Court North Andover,MA requesting a

Upon a motion made by John Pallone and 2n6 by Robert Ford, the Board voted to GRANT a Variance from Section
7,Paragraph 7.2&7.3 for dimensional relief of side setbacks within Table 2,in order to rebuild a collapsed garage as
per the previous footprint from plans stamped by the Registered Land Surveyor,Robert James Sotiros,dated
September 6,2001 for the property at 18 Wiley Court. The maximum height of the rebuilt garage shall not exceed 13
feet,4 inches as shown on the plan submitted to the Zoning Board of Appeals on October 11,2001. Upon a motion by
John Pallone and 2"d by Robert Ford,the Board voted to GRANT a Special Permit from Section 9&Paragraph 9.2 in
order to rebuild a pre-existing nen-conforming structure within R-4.Voting in favor. WJS/WFS/RF/JP/EM.
The Board finds that the applicant has satisfied the provisions of Section 9,paragraph 9.3 of the Zoning Bylaw and
that the granting of this variance will not adversely affect the neighborhood or derogate from the intent and purpose of
the Zoning Bylaw.
Furthermore,if the rights authorized by the Variance are not exercised within ane(1)year of the date of the grant,it
shall lapse,and may be re-established only after notice,and a new hearing. Furthermore,if a Special Permit granted
under the provisions contained herein shall be deemed to have lapsed after a two(2)year period from the date an
which the Special Permit was granted unless substantial use or construction has commenced,it shall lapse and may be
re-established only after notice,and a new hearing
