Morse 79 Marblehead St. and 87-89 Union St. Petition No. 27-180 Daniel Long, Town Clerk Town Office Building North Andover, Mass. 01845 Dear Sir: A public hearing was held by the Board of Appeals on October 14, 1980 upon application of Robert K. Mattheson and David J. Morse seeking a variance from Sec, 7, Par. 7,1, 7.2, and 7.3 of the Zoning By-Law. The hearing `waft advertised in the North Andover Citizen on September 25 and October 2, 1980 and all abut-tors were notified by regular mail. The following members were present and voting: Frank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice-Chairman; Richard. J. Trepanier, Esq., Clerk; William J. Sullivan; 'and Augustine Nickerson. The petitioner seeks a variance to divide a parcel of land located on Marblehead St. and Union St. Specifically, the petitioner seeks a variance of Sections 7.11 7.2, and 7.3 of the By-Law as follows: Lot A: Area, frontage, side, and front set back variances; Lot B: Area, frontage, side, and front set back variances. The petitioner's counsel presented evidence showing that the property was purchased in 1913 as one lot. Subsequently, two dwellings were constructed on the premises and the owner is now deceased. Pursuant to the desires of the deoedant as set forth in a will, the property should be divided for conveyance to the petitioners. Upon a motion made by Mr. Trepanier and seconded by Mr. Frizelle, it was voted unanimously to grant the variances as requested. The Board finds that the unusual shape of the parcel in question, coulpled with the fact that two dwellings have been constructed thereon, present a hardship to the petitioners to preserve the property as one parcel. `Robert K.
