IIpon aWication of WMM and ASA T. NAPCLITM to the North Andover Board
of Appeals for a variation under Section 6, para. 6.62 of the North Andover
Zoning By-laws so as to permit the erection of a single family residence, a
public bearing was bold on April lO, 1967 by the North Andover Board of Appeals.
The hearing was build in the Town Hall facilities after having been advertised in
the Lawrence Nagle Tribune an the dates; March 25 and April 1, 1967 and with all
abutters duly notified by certified mail. The members of the Board present and
voting were: John J. Shields, chairmen,; James A. Deye, Secretary; Daniel T.
OtLeary, Arthur Drummond and Donald J. Scott. The applicants were represented
by Attorney Anthony Y. Randazzo.
Attorney Anthony Y. Randazzo, appearing for the applicants, pleaded justification
for this petition on several counts. First, the land in question is comprised
of four, fifty by one hundred foot lots. All owned in common ownership by the
applicants with their home being roughly centered on two of the late. It was
their desire to subdivide the four lots tae parcel) into two, ane hundred by
one hundred foot lots. One of the proposed lots would, be theirs and the second
would be conveyed to their daughter and prospective sonoia«-lax. Denial. of the
application would result in financial hardship to the applicants. Seconud$. the
proposed subdivision would be in complete harmany with the dwellings and lots
in the immediate area.
There were no objections heard to the proposal although it was brought aw.t in
general discussion that the application, per se, van is error in that the street
number cited in the advertising and on the application of 1846* should in fact be
"301 as noted on this filing. This error was explained as_a typographical error
andas it did not affect the intent of the petition no other action was taken.
A motion was made and carried that the application be taken under advisement.
During this period it was noted that the arguments presented by Attorney
Randazzo for the applicants were in substance valid. It was also noted that the
appliamts had held the land in question prior to the general revisions of the
Zoning By-saws adopted in 1956.

A motion was made by Member Donald Scott to grant the application, wbich was
seconded by Member John J. Shields and voted favorably with Member Daniel T.
O'Leary abstaining.
The principle reasons for granting the variance are as follom
1. To dery the application would cause financial hardabip to the apPlicants.
2. The proposed subdivision Would result in two lots well in beeping with the
mamovading neighborhood.
3. Tbat granting the variance would not deviate from the intent and Purpose of
the U ing By—Laws:
