Long: 'rrre North Andover Planning Board held a public hearing on July 13 , 1e9 , upon the application of Sanlau Realty Trust, 231 Sutton Street, North Andover, MA, requesting approval of a Site Plan Review Modification, pursuant to the provisions of the North Andover Zoning Bylaw, Section 8 . 36 , Revisions to Approved Site Plan. The hearing was duly advertised in the North Andover Citizen on June 22 and June 29 , 1989 and all parties of interest were notited. The following members were present: George Perna, Chairman; John Simons, Clerk; Erich Nitzsche and Michael Leary. The petitioner seeks modification of an approved Site Plan Review. Joar_ Simons read the legal notice to open the public hearing. Let'te4s were read :from Chris Huntress, Environmental Planner and Bob Nice-tta, Building Inspector. Huntress explained to the Board what the applicant was proposing on the modification of the site plan. He wants to take oft from the Order of Conditions, the concrete retaining wall that was supposed to be built. He would like to construct a rip-rap retain_nc; wall to hold back the silt. Present at the public hearincr were Santo Messina, Ann Messina and Sheldon Penoir, architect for the Housing Authority. A lengthy discussion took place on boundary lines and the po,�itio: of the building built by the Housing Authority, between the appi:i_cant and the architect and the Board. Page George Perna stated that the issue being the retaining wall and shoud be resolved with the Building Inspector. Ar. updated As-Built Plan is needed before a site visit. Also needec—are documents for easements and/or land swap. A motion was made by John Simons to continue the public hearing . The motion was seconded by Erich Nitzsche and voted by those present. ; August 10, 1989, the Planning Board held a regular meeting. The f,_iiowing members were present: George Perna, Jr. Chairman; Erich Nitzsche and Jack Graham. Paul Hedstrom arrived at 9: 05 p. m. John Simons was absent. A motion was made by Jack Graham to continue the public hearinr, until the Board had a quorum. O . Axgust 24, 1989 the Planning Board held a regular meeting. The foil :wing members were present: George Perna, Jr. , Chairman; John '�imons, Clerk; Erich Nitzsche and Jack Graham. , ohn Simons read a letter that was sent to the applicant from Chris c:untress, Planner. The letter was on the concerns the Board had ex.p.-:essed. George Perna stated what the Board is looking now, to put back the ra_taining wall as it was originally on the approved plans. zan .o Messina spoke to the Board on the condition of the site as i.,. -e_iates to the retaining wall , citing that it was a mess. Mr. "Ie ',s a.na stated that erosion from the Housing Authority was the reason .'::ar the conditions on site . Mr. Messina wantg to plant juniper .rees to control the site . The Board wants a retaining wall , e: c!ht feet high. ie Minnicucci , Housing Authority Director, spoke to the Board the easements not being recorded. A r;iotion was made by John Simons to continue the public hearin and set up a site visit and workshop. The site visit will be Septe^'ber 6 , 1989 . The following members were present: George Perna, Jr. , Chairman; John Simons , Clerk; Erich Nitzsche, Jack Graham and John Draper. . + ris Huntress , Planner, stated that he had received revised plans of the retaining wall but they were not drawn to scale . 111 t4essina stated that the landscape plan had not been addres._ec: because he was going to plant grass. Huntress, gave the Board a copy of a draft decision. The Pins need to be drawn to scale and a Professional Land Surveyo•,:• stamp is needed. Crich Nitzsche asked of the boundary lines were correct. Chris Lr.tress asked that the fire lane and no parking be painted on the way behind the building. Erich Nitzsche wanted language put in the iecision relative to the trees being replaced if they should die . Chris Huntress to find the technical name for the style of retaining wall that will be used in the back of the building. A :notion was made by Erich Nitzsche to close the public hear,,-:,.. and approve the draft decision as amended. The motion was seconded by John Draper and voted unanimous by those present. The Planning Board makes the following findings regarding this Special Permit as required by section 8.3 of the Zoning Bylaws: 1. The proposed use and site design for this lot are appropriate, due to it's location in Town. 2 . Adequate vehicular and pedestrian access into the surrounding site has been provided. 3 . The applicant has met the requirements of the Town for Site Plan Review as stated in Section 8.3 of the Zoning Bylaw. 4. Adequate and appropriate facilities will be provided for the proper operation of the proposed use. The Planning Board finds under Section 8.35 of the Zoning Bylaw that the proposed site plan, together with the following conditions, complies with the Town Bylaw requirements. Upon reaching the above findings, the Planning Board approves this Special Permit based upon the following conditions which shall be submitted to the Board prior to signing the documents to be filed with the North Essex Registry of Deeds. 1. The final plans, which shall be filed with the North Essex Registry of Deeds, shall include the following in one packet: a. Proposed Retaining Wall for San Lau Realty Trust. Dated November 14, 1989. (With appropriate revisions as noted in this decision) b. Landscape Plan, as approved by the Town Planner. All plans shall be on 24" x 36" sheets 2. All Planning Board Order of Conditions, issued herein, are to be placed upon the recorded Final Plans, ( Cover Sheet ) prior to endorsement and filing with the Registry of Deeds. 3 . Any Plants, Trees or Shrubs that have been incorporated into the Landscape Plan approved in this decision, that die within one year from the date of this approval, shall be replaced by the owner. If the applicant fails to comply with this condition a modification to this approval shall be required by the Planning Board. 4 . All prior conditions, that are not herein modified by this decision, are to remain in full force and effect. 5. The roadway behind the buildings shall maintain a twenty two (22) foot width at minimum, and in no instance shall the wall or curbing be brought closer to the building than as shown on the approved plans. 6. Prior to the endorsement of the record plans a final landscape plan shall be submitted to, and approved by the Town Planner. Said plan shall be part of the record plans and shall be filed with the North Essex Registry of Deeds. 7. All construction shall commence by May 1, 1990, and shall be complete by July 1, 1990. 8. The Plan entitled Proposed Retaining Wall for San Lau Realty Trust, Dated 11/14/89, is not drawn to the scale shown on the plan. The plan shall be redrawn to scale and approved by the Planning Board prior to endorsement and filing with the Registry of Deeds. 9. A Fire Lane shall be delineated on the ground along the entire back portion of the project and shall be approved by the NAFD. This is to keep vehicles from blocking the 360 degree access to this site. Any vehicles found unattended in this lane shall be subject to a ticket or tow. 10. Final Site Plan shall be stamped and signed by a Professional Land Surveyor, certifying that all buildings, property lines and retaining walls are shown as found on the site. 11. Prior to a Certificate of Occupancy being issued for any structures, the site shall be reviewed by the Planning Board.
